대통령의 사고 또는 궐위로 인하여 발생하는 헌법적 쟁점들에 관하여

On the Constitutional Controversies Engendered During the Time When the Office of the Presidency is Vacant or the President is Unable to Perform His or Her Duties

헌법상 대통령은 국가의 원수이자 행정부의 수반이다. 그런 점에서 대통령의 사고 또는 궐위는 국가작용에 영향을 미치는 중대한 문제이다. 지난 3월 10일 대통령의 파면결정으로 다음 대통령이 선출되기까지 대통령의 궐위 상황을 경험하였으며, 그 이전에도 국회의 탄핵소추의결에 의하여 탄핵심판절차가 개시되면서 대통령의 사고 상태도 겪었다. 한편, 대통령의 무능력이 극에 달하여 이것이 대통령이 그 직무수행에서 배제되어야 하는 사고라고 볼 수 있는지, 대통령이 국회에 여야 합의에 의한 국무총리후보자의 추천을 요구하고 국회가 이러한 후보자를 추천할 경우 대통령이 이를 국회에 동의요청하고 국무총리로 임명할 수 있는지, 또한 이렇게 임명된 국무총리에게 대통령의 권한을 실질적으로 행사하게 하고 대통령은 직무수행의 일선에서 후퇴하는 방안은 가능한 것 인지 등에 대해서도 논란이 있었다. 특히 대통령의 권한을 대행하는 자가 어떤 범위에 서 대통령의 권한을 행사할 수 있는지와 관련하여 국회에서는 이에 관한 법률안을 제출 하였으며, 헌법재판소 재판관의 임명과 관련하여 치열하게 논의가 이뤄지기도 하였다. 헌법이나 법률이 현실에서 발생할 수 있는 모든 경우를 상정하여 규정하기는 쉽지 않다. 특히 헌법은 그것이 헌법사항의 골격이나 윤곽을 정하는 특성을 가지고 있으며 그 문언이 추상적이고 개방적이기도 하다. 그런 만큼 헌법이나 법률이 예정 또는 예상 하지 않는 사건이나 상황이 발생하면 단지 헌법과 법률의 해석만으로 처한 상황의 해법 을 도출해 내기란 쉽지 않게 된다. 이 글은 2016년 11월 이른바 박근혜-최순실 사건 이 후 일련의 헌법적 사건의 전개과정에서 드러난 다양한 헌법적 쟁점을 정리하여 향후 헌 법적 논의의 기초로 삼고 헌법과 법률의 개정에 참고가 되도록 하기 위한 것이다.

The President shall be the head of the state, and also the head of the Executive Branch in which the executive power shall be vested. But in case the President has violated the Constitution or other Acts in the performance of official duties, the National Assembly may pass motions for his or her impeachment. The President against whom a motion for impeachment has been passed shall be suspended from exercising his or her power until the impeachment has been adjudicated. If the office of the presidency is vacant or the President is unable to perform his duties for any reason, the Prime Minister or the members of the State Council in the order of priority as determined by Act shall act for him or her.After the Park-Choi Corruption Scandal poped up in October 2016, so many constitutional issues engendered relating to the interpretation of Korean Constitution. Shall the Prime Minister act for the President when the President is unable to perform his or her duties or does nothing? Is there any limit to excercise the President’s power by the acting President? Can the acting President appoint the Justices of the Constitutional Court or other Offices provided in the Constitution? This article deals with the constitutional controversies engendered during the time when the office of presidency is vacant or the President is unable to perform his or her duties. Some acts related to the controversies should be revised.
