금융소비자보호 관련 집단소송 및 징벌적 손해배상제도 도입 당부에 관한 논의

Discussions on the introduction of class action and punitive damages for the financial consumer protection

최근 들어 금융소비자보호를 위한 집단소송제도 및 징벌적 손해배상제도의 도입에 관하여 활발하게 논의되고 있다. 징벌적 손해배상제도는 기존에 가해자의 고의 또는 과실에 따라 발생한 실제 손해액을 배상하여야 하는 전통적인 손해배상원칙에 더하여 손실상태와는 별개로 공익적 목적을 위하여 부가적인 배상을 명하는 제도이다. 그리고 집단소송제도는 피해자들이 개별적으로 소를제기하여 구제받는 것이 어려울 경우, 피해자들 중 1인 또는 수인이 전체를 대신해서 소송을 제기하고, 소송에서 승소할 경우 그 효력이 다른 피해자들에게도 발생하는 제도이다. 집단소송제도와 징벌적 손해배상제도는 소비자들의 권리를 효율적으로 실현하고, 기업의 불법행위를 효과적으로 견제하기 위하여 탄생한 제도로 우리나라에도 이미 여러 법률을 통해서 도입하고 있다. 그런데 최근에 활발히 논의되고 있는 금융회사를 대상으로 하여 집단소송제도 및 징벌적 손해배상제도를 도입하는 것에 대해서는 적어도이미도입하여운영하고있는제도를면밀히검토해보고여기에서드러난문제점에 대하여 우선적으로 개선하고 난 이후에 검토하는 것이 바람직하다. 막강한 자본과 권력을 가지고 악의적으로 불법행위를 저지르는 악덕 기업을 응징함으로써 우리 사회의 법규 준수기능을 강화한다는 의미에서 집단소송제도와 징벌적 손해배상제도의 도입에 대해서는 기본적으로 찬성하는 바이지만, 동 제도의 운영 과정에서 실제로 나타난 역기능 또한 매우 심각하다고 판단되기 때문에, 이를 금융회사에 까지 확대 적용하기에 앞서 신중한 사전 검토 작업이 필요하다.

Recently, the issues of class action & punitive damages for financial consumer are actively reviewed. Punitive damages is a system that gives additional compensation for the public interest purpose apart from the loss state in addition to the traditional damages compensation principle which must compensate the actual damages that occurred according to the intention or negligence of the perpetrator. And the class action is effective in cases where it is difficult for the victims to receive remedies individually, in which case one or more of the victims filed a lawsuit on behalf of the whole victims. Class action and punitive damages were introduced before in order to effectively realize the rights of consumers and effectively check the illegal activities of companies. However, the recent introduction of class action and punitive damages system for the financial companies that are actively being discussed recently requires at least a thorough examination of the prior systems already introduced and operated. Although I am basically in favor of the introduction of the class action lawsuit and the punitive damages system in the sense of strengthening the function of adhering to the laws and regulations of our society by punishing the vicious corporations that commit malicious illegal acts with enormous capital and power, since the dysfunction actually observed in the operation process is also considered to be very serious, a careful preliminary review is required before it can be extended to finance companies.
