1953년 근로기준법의 노동정책적 의의

“The Labor Policy Implications of the Labor Standards Act 1953”

4차 산업혁명이 몰고 올 노동의 변화에 대하여 우리는 어떻게 대응할 수 있을까? 이에대한 답을 찾기 위해서는 우선 과거의 우리 입법자들은 노동의 변화에 어떻게 대응했는지살펴야 할 것이다. 이러한 취지에서 과거를 돌아보면 우리 노동에 있어 과거의 가장 큰 변화는 1953년 근로기준법 제정을 통하여 노동을 법적 규율 아래 둠으로써 근대적 노동관계의확립을시도한것이라고할수있다. 그러나정작우리는그간제정법이전쟁중에충분한 검토 없이 일본 노동기준법을 모방하여 제정하였다는 이유로 이를 과소평가 해왔고 이에 대한 충분한 연구도 소홀히 하였다. 이 논문에서는 그간 연구가 미흡했던 1953년 근로기준법의 제정 배경과 과정, 특징을 살펴봄으로써제정법의노동정책적의의에대해기존견해와는다른견해를제시하고자하였다. 즉, 근로기준법 제정의 사회․경제적 배경과 정치․이념적 배경, 제정 과정에서의 국회심의 내용을 살펴보면 제정법은 단순한 모방입법이 아니라, 1948년 국가 수립 후 우리나라가 근대국가로의 전환을 위해 필요했던 노동관계에 대한 기본적인 계획도(計劃圖)이고, 경제체제로써 자본주의를 도입하기 위한 법적 장치였다. 또한 제정법은 노동법의 이념을 구체화하고다른노동법에대한해석의기준이되는노동관계에있어기본법으로기능하였고,현실적인 규범력을 가지기 전까지는 노동운동의 이정표로서의 역할을 하였다.

How can we respond to the changes in labor that the Fourth Industrial Revolution will bring? In order to find the answer, we must first look at how past legislators responded to changes in labor. From this point of view, the most significant change in the past has been the attempt to establish modern labor relations by establishing the labor standards under the Labor Standards Act 1953. However, we have underestimated it because it enacted by imitating the Japanese law without sufficient consideration during the war, and sufficient study has not been done. In this paper, I tried to present a different view from the existing view on the labor policy implications of tthe Labor Standard Law 1953 by examining the background, process, and characteristics of it. In other words, if we look at the social and economic background, political and ideological background of the establishment of the Labor Standards Act, and the deliberations of the National Assembly during the legislative process, it is not a mere imitation legislation, but a law that was necessary for the transformation of Korea into a modern nation. It is also a basic plan for the labor relations, and it is a legal device for introducing capitalism as an economic system. It also functioned as a basic law in the labor relations that embodied the ideology of the labor law and became the standard of interpretation of other labor laws. It also served as a milestone in the labor movement until it had realistic normative power.
