디지털저작물에 대한 권리소진원칙의 확대적용에 관한 연구

A Study on the Exhaustion of Right in the Changing the Distribution Market Environment of the Copyrighted Work

우리는 아날로그 시대가 아닌 디지털 시대에서 살아가고 있다. 이것은 저작물을 접하는데에 있어서도 마찬가지이다. 예컨대, 종이책보다는 전자책, LP나 CD 보다는 다운로드를통해음악을들으며컴퓨터프로그램의구입도마찬가지이다. 이러한상황에서아날로그시대의 산물인 권리소진원칙을 그대로 고수하는 것은 창작자들에게 창작 활동의 동기를 부여하는 데에 필요한 정도의 독점권을 부여하면서도, 그 권리범위 이외의 영역에서는 이용자들이 그 창작의 열매인 저작물에 용이하게 접근하여 그것을 충분히 이용할 수 있도록보장하여 종국에는 문화발전을 이루려는 저작권법의 이념에 부합하지 않는다고 생각한다. 권리소진원칙은 저작물의 원본이나 그 복제물이 해당 저작권자의 허락을 받아 판매 등의 방법으로 거래에 제공된 경우에 저작권자가 더 이상 배포권을 주장하지 못하도록 하여거래의안전과소비자의이익을보호하려는취지의제도이다. 그러므로디지털시대의저작물 이용환경 변환에 따른 권리소진원칙의 대상에 대한 확장가능성이 논의의 중심에 있다. 현재 이에 대한 우리 법원의 판단은 없으나 영미나 유럽의 국가들에서 판단이 나오고 있으나 그 명확한 해결을 보지 못하고 있는 실정이다. 또한 미국저작권청도 DMCA(Digital Millenium Copyright Act; 1998)제정 당시에 논의되었던 문제이기도 하였으며 이에 대한 해석론도 분분하다. 따라서 본고에서는 현재 미국과유럽에서 문제시되었던사건에 대한 판례와 해석론을 검토하여 디지털저작물의 권리소진원칙의 적용에 가능성에 대해 고찰해 보았다

The principle of exhaustion, or the first sale doctrine (US), in copyright means that once a copy of a work is put on the market with the consent of the right holder he or she will not be entitled to control the further distribution of the copy. It is well settled that the exhaustion rule applies to the distribution of tangible copies (books, CDs, DVDs etc), but its application to the online context is controversial. According that digital networks emerge as the dominant means of distributing copyrighted works, the exhaustion of right has increasingly been marginalized. To the extent the use and alienation of copies entails their reproduction and adaptation to new platforms, the limitations of the exhaustion places on the exclusive right of distribution decrease in their legal and market impact. This fact of the modern copyright marketplace has led to calls for statutory clarification of digital exhaustion of rights. In the UsedSoft case the Court of Justice of the European Union nevertheless applied the exhaustion rule of the Computer Software Directive to a situation where ‘used licenses’ of computer software were passed on to third parties enabling them to download the software from the right holder’s website. Therefore, This article will approach the question of extending the exhaustion of right into the digital realm by analyzing the characteristics of physical copies that already avail themselves of the exhaustion and determining whether those relevant characteristics are also present in certain digital copies. This article, as reviewing the case and theory on the exhaustion of right of digital works, will propose an alternative on the digital exhaustion of right.
