고도 인터넷환경 하에서의 개인정보보호에 관한 연구

A Study on the Private Information Protection under High Internet Environment

우리의 일상생활은 인터넷환경의 고도화에 힘입어 나날이 편리해지고 있다. 고도화된 인터넷환경이란 빅데이터, 클라우드시스템, 사물인터넷 등을 주로 가리키는 말인데, 이러한 고도 인터넷환경은 우리 생활에 편리함과 합리성을 제공하는 장점도 있지만 그 이용과정에서 개인정보가 유출되기 쉽고, 이용과정 자체가 해킹위험에 노출되어 있어 경우에 따라서는 이들 문명의 이기가 문명의 흉기로 둔갑할 수도 있는 최악의 상황마저 염려된다. 이러한 인터넷환경의 고도화에 따라 사이버범죄 또한 고도 인터넷범죄로 진화하고 있어 그에 따른 형사특별법의 재정비가 필요하고, 특히 개인정보보호에 관한 법제도 재검토가 요구되며, 아울러 인터넷이용자들의 윤리의식 또한 크게 제고되어야 한다. 이런 과정을 통하여 고도 인터넷사회에서의 우리의 자율규제의식이 정착될 수 있게 될 것이다. 빅데이터, 클라우드, 사물인터넷 등 고도인터넷 발전의 선결문제로서 반드시 사이버보안 문제가 해결되어야 한다. 보안이 취약하여 해킹을 당하게 되면 큰 피해를 야기할 수 있기때문이다. 벌써부터 사물인터넷과 관련하여 다양한 사이버범죄가 발생하고 있는데, 이러한 현상은 더욱 확산될 전망이다. 따라서 고도인터넷시대에 걸맞은 사이버보안 수준을 만들기 위한 기술적․정책적 해결방안이 지속적으로 논의되고 법제도적으로 완비되어야 한다. 그리고 사이버보안시장을 활성화하고 특히 전문인력을 대규모로 육성해야 하며, 체계화된 컨트롤타워를 두어 신속한 침해대응방안을 수립함으로써 고도 인터넷범죄에 효율적으로 대처해야 한다. 아울러 피해를 미연에 방지하기 위하여 사이버보안의 중요성과 필요성에 대한 국민의 인식을 제고시키는 노력이 필요하고 이를 위하여 정부차원의 교육 및 홍보가 절실히 요망되는 바이다.

Our daily lives are becoming convenient day by day thanks to the advancement of the internet environment. The advanced Internet environment means Big Data, Cloud Systems, Internet of Things or Internet of Everything. This internet environment has the advantages offering convenience and rationality in our lives, but the personal information could be leaked in the course of using it and the using process itself is exposed to the risk of hacking, and so even the worst situations would be worried that the convenience of civilization might be disguised as a deadly weapon of civilization. In accordance with the advancement of the internet environment cybercrimes are also being evolved into highly internet crime, and so we need special criminal acts and we should, in particular, review the legal system relating to privacy. In addition, ethics of internet users should be greatly enhanced. Our self-regulatory consciousness will be able to be settled at the advanced internet society through these processes. By the way, cyber security issues must be resolved as the prerequisite of high development of Internet society through Big Data, Cloud, Internet of Things etc. When security is vulnerable to hacking it could cause a lot of damage. There are already lots of cybercrimes related to the Internet of Things and this phenomenon is expected to be more widespread. Therefore, to establish the cyber security level proper to the advanced internet age, the technical and political solutions should be discussed and fully equipped with legal systems. We have to vitalize the cyber security market and especially train expertises in large-scale, and quickly and effectively cope with advanced internet crimes by placing systematic control tower and establishing the infringement rapid response measures against infringement. In addition, in order to prevent the damage we must make efforts to raise national awareness about the importance and necessity of cyber security and the government should educate people about it.
