Constitutional Law Scholar Park Il-kyung

박일경은 우리 헌법사 및 헌법학사 초기에 광범한 주제에 걸쳐서 저술활동을 하였던 대표적인학자이다. 또 박일경은 법실증주의적 방법론에 따라서 헌법학을 연구한 거의 전무후무한 학자이다. 이 두 가지 점에서 박일경은 우리 헌법학의 개척자적 위상을 가지며, 박일경의 헌법학연구를 통하여 우리 헌법을 둘러싼 당대의 쟁점과 헌법이론을 깊이 있게 이해할 수 있다. 이 글은 박일경의 헌법학방법론과 헌법에 대한 이해를 추적하는 목적을 갖는다. 19세기 중후반 독일에서 법학방법론을 지배했던 법실증주의는 추상화된 인간과 생활관계에 적용되는 규범의 논리성과 객관성을 구축하여 완결된 법적 질서를 형성하고, 이와 같은 기반 위에서 법적 안정성을 유지하며, 개인의 자유를 실현하려는 야심적인 시도였다. 그러나 법실증주의는 불안정한 실험의 시대에 해당하는 1948년 이후 우리 (헌법)의 시대에 비추어, 그리고 보편적이고 추상적인 가치가 현실과의 상호작용속에서 실현되는 헌법의 특성에 비추어 적합한 연구방법론이 될 수는 없었다. 이 글에서는 박일경의 법실증주의적 방법론에 따른 헌법의 이해가 민주주의, 기본권, 그리고 국가조직의 이론형성 및 해석에 미쳤던 영향을 분석하면서 박일경 자신의 헌법이론을 정리·평가한다. 특히 국민주권에 대한 법실증주의적 이해는 이 주제를 다시 점검하는 계기를 부여하기에 충분하다. 이러한 작업은 동시에 박일경의 시대에 제기되었던 헌법적 쟁점을 추출하여 정리하면서, 우리 초기헌법학사의 일부를 복원하고, 또 당시 헌법에 대한 이해를 깊이 하는데 기여할 것으로 기대한다. 이에 비해서 박일경의 현실정치참여에 대한 평가는 이 글의 과제가 아니다.

Professor Park Il-kyung contributed to form and develop the korean constitution since 1948 through his academic articles on the constitutional themes as well as taking part in the process of the constitutional enactment. So he is a part of the history of the constitutional theory and the constitution itself. What the research method concerns, Park Il-kyung was the only scholar who adopted the method of legal positivism, and from that point of view he widened the possibility to analyse and assess the korean constitution. However, his method of constitutional research lacked the conditions for working, because the legal positivism presupposes a stable and ‘belle epoque’, whereas the korean society and constitutional realities at that time stood under the turbulent political and socio-economic circumstances. His method of the constitutional research could not also be reconciled with the characteristics of the constitutional law, which just in the interaction with the constitutional realities realizes its normative effect. In spite of less practicability of his method of constitutional research, some lesson therefrom should not ignored for the next generations of academics. That is the warning against the subordination of the constitutional law under the political realities und values, and the reduction of the normative effect. This warning is so much valuable, as the constitutional law has a strong elements of the political kind. From this point of view the constitutional theory of Park Il-kyung gives a far reaching way of thinking, regardless of its theory and understanding of the constitution in detail.
