가짜뉴스의 심각성과 법적대응방안

가짜 뉴스는 전 세계적으로 확산되고 있으며, 국내에서도 크게 이슈화되고 있다. 이미 국내에서도 사설 정보지, 낚시 뉴스 등이 개인, 기업 등에 경제적, 정신적 피해를 끼치는 등 사회 문제가 되고 있다. 이에 따라 최근 언론 조정에 대한 청구 건수가 증가하고 있으며 그 중 명예 훼손 비중이 약 95%에 이르고 있다. 가짜뉴스는 기존의 찌라시나 루머와는 달리 고도의 정치적·경제적 목적을 가지고 제작 된 뉴스로서 그 파급효과로 우리 사회와 경제에 미치는 영향이 나날이 증대되고 있다. 사회적으로는 불신, 불안감을 조장하고, 여론의 분열을 낳고, 특정집단에 대한 증오감을 조성한다. 또한 경제적으로도 개인과 기업에 직·간접적인 타격을 주는 것으로 나타났다. 가짜뉴스를 근절하기 위해서는 형사법적인 입법과 교육정책면에서의 입법이 필요할 것으로 보인다. 형사처벌조항은 그 유포자를 처벌하는 것과 소셜미디어의 관리책임을 묻는 것으로 분류될 수 있다. 현재까지 우리나라는 최초 유포자를 처벌하는데 초점이 맞추어져 있었다. 그러나 개인에게 책임을 묻는 것과 동시에 소셜미디어사업자에게 가짜뉴스를 방 치한 관리책임을 묻는 입법이 필요하다. 또한 미국의 경우처럼 성숙한 시민의식함양으로 가짜뉴스를 극복할 수 있을 것이다.

Fake news is being spread all over the world and is definitely becoming an issue domestically. It is already damaging individuals and companies in monetary values and morale via private information magazines and phishing news. Hence, there are an increasing number of enquiries to mediate news agencies and 95% of them are defamation. Fake news is different to existing private information channels as they are purposely produced to manipulate politic and economic agenda. The effect of it on the society and economic is ever increasing. Members of society are in disbelief of each other and individuals are in anxiety. Public opinions are being divided and hatred towards specific group is being created. It is also striking individuals and companies economically in both direct and indirect ways. To prevent fake news, it is important to realign criminal laws and education policies. Criminal law can be subdivided to punish the origin of source and to give social media companies the responsibilities for the management of its contents. At this moment, the focus is on punishing the origin of source. But there needs to be legislation in relation to the management of social media companies for not taking the full responsibilities on its contents. It is worth a while to take a look at how US has subjugated the fake news with maturity in their citizenship.
