이 논문은 약속에 의한 자백의 증거능력의 유무에 관하여 임의성의 유무를 근거로 그 해결방안을 새로이 모색하고 있다. 이 논문에서는 임의성의 의미에 대한 재검토를 통해서 임의성에 관한 판단기준으로서 자기결정의 법리라는 새로운 개념을 도출하고, 자기결정의 허용요건과 자기결정의 허용한계에 관하여 고찰함으로써 그 해결방안을 제시하고 있는 것이다. 자기결정의 허용요건으로서는 정보제공자측의 요건과 정보수령자측의 요건으로 나누어살펴보고 있다. 전자의 주요요건으로서는 정보내용(약속)의 진실성과 정보제공방법의 제시성을 제시하고, 후자의 주요요건으로서는 정보내용(자백)의 진실성을 제시하고 있다. 또한자기결정의 허용한계로서 위법한 약속과 심히 부당한 약속의 경우를 예시하고 있다. 여기서 이 논문은 ‘Ⅰ. 서론’, ‘Ⅱ. 자백배제법칙의 근거’, ‘Ⅲ. 약속에 의한 자백의 증거능력’ 및‘Ⅳ. 결론’의 순으로 구성되고 있다. 나아가 ‘Ⅲ. 약속에 의한 자백의 증거능력’은 다시 ‘1. 비판적 검토’, ‘2. 자기결정의 허용요건’ 및 ‘3. 자기결정의 허용한계’로 세분되고 있다.

This paper attempts to seek the solution for admissibility of evidence obtained by confession with promise based on voluntariness of the confession. This paper derives self determination theory as new criteria for voluntariness of the confession through a review of meaning of voluntariness of the confession. At the same time, this paper proposes the solution for admissibility of evidence obtained by confession with promise by considering requirements and limits of self determination. The requirements of self determination are devided into requirements of information provider side and requirements of information recipient side. The former needs mainly truth of information(promise) and presentation of information within the limits of inducement, while the latter needs mainly truth of information(confession). This paper also presents illegal promise and very unfair promise as criteria for limits of self determination. The contents of this paper are as follows: Ⅰ. Introduction Ⅱ.
