최근 바이오매트릭스의 이용이 본인인증 방법으로 크게 주목을 받고 있다. 인간의 신체적ㆍ행동적 특징을 이용하여 특정한 개인이 본인임을 인증하는 구조인 바이오매트릭스는 여러 분야에서 정보보안확보ㆍ안전보장 등의 목적으로 그 이 용영역이 늘어나고 있는 상황이다. 구체적으로 종래 바이오매트릭스는 일정한 제한된 시설물의 출입관리 등과 같은 한정된 공간에서 주로 이용되었지만, 현재는 출입국관리ㆍ금융, ‘주거지역보안’(homeland security), 전자상거래 등 광범위한 분 야에서 활용이 기대되고 있다. 일반적으로 뛰어난 보안성의 관점에서 바이오매트릭스의 이용에 대해 본인인 증정밀도 등 기술개발의 측면에 주목하기 쉽지만, 법적 문제의 검토도 중요하다. 그 대표적인 예로 바이오매트릭스는 각 개인의 유일하고 변경할 수 없는 생체정보를 이용한다는 점에서 프라이버시ㆍ개인정보보호의 문제, 위변조로 인한 문제,본인거부(false rejection)ㆍ타인허용(false acceptance)의 문제, 생체인식데이터의 사 후적인 변경문제, 장애인의 접근성(accessibility) 문제 등 여러 해결과제를 야기하고 있다. 이 논문은 바이오매트릭스의 이용에 따라 법적으로 어떠한 문제점이 발생하며, 그에 수반되는 현행법상 해결과제를 지적함으로써 법해석ㆍ입법론상의 방향성을 제시하는데 목적이 있다. 그리고 이 논문에서 기술한 바이오매트릭스의 이용에 따른 각 개별논점들은 모든 법적 쟁점을 다룬 것은 아니지만, 적어도 이 분야의 초기단계의 검토로서 추후 연구에 단초를 제공할 것으로 생각한다.
In recent years, the use of biometrics has come to the fore as a personal authentication means. The territory of the use of biometrics, a structure to authenticate a person by the use of the characteristics of body or behavior, expands in the various fields on the purpose to secure information security and homeland security. In detail, while biometrics had been used in the limited area such as facility security, biometrics has been useful for a variety of fields such as finance, homeland security, electronic commerce and etc. Actually considering legal issues is important while, in general, technology development like accuracy of personal authentication in the use of biometrics attracts an attention in the perspective of superior security. There are various of legal problems such as privacy or protection of personal information, forgery or falsification, false rejection or false acceptance, changeability of biometric data after the fact, accessibility of the disabled and so on since biometrics uses biometric information which is unique, unchangeable. This thesis has a purpose to suggest a directivity on the legal construction and legal policy to indicate what kind of a legal issues occurs by the use of biometrics; and a resolution under the current laws related to the said issues. Besides, while it did not deal with every legal aspects about respective issues followed by the use of biometrics, this thesis, as a survey in the early stage on this field, would provide a clue for further research.
