The Challenges of Climate Change and the U.S. Energy Law and Policy

환경문제와 에너지문제는 매우 밀접하게 관련되어 있음에도 법정책적 측면에서는 통합적 조화를 이루어 오지 못하였다. 환경법정책과 에너지법정책은 서로 별개의 분야로 인식되어 각각 발전해 왔기 때문이다. 미국의 에너지법정책은 화 석연료 소비를 조장하는 방식의 패러다임의 지배를 받아왔고, 에너지 소비로 인해 발생하는 환경적 영향을 제어하는 환경법정책 역시 그 자체의 논리와 규제의한계 때문에 정책적 연계가 제대로 이루어지지 않았다. 기후변화를 야기시키는 온실가스를 규제하고, 에너지 사용을 온실가스 발생 측면에서 규제하는 포괄적이고 통합적인 입법은 몇 차례 미국연방차원에서 시도되었지만 성공하지 못하였다. 그러나 최근 이를 교정하기 위한 사법부를 통한 구제시도가 있었고, 주정부 주도로 재생에너지 사용과 에너지효율성을 증진시키기 위한 제도가 시도되고 있다. 특히 재생에너지공급의무화제도(RPS)는 탄소배출권제도와 함께 에너지 이용과 환경적 영향을 동시에 고려하는 의미 있는 제도로 주목받고 있다.

Energy and environment, although closely related, have not been harmoniously dealt with each other in terms of law and policy. Law and policy on energy and environment have each recognized its problems separately and thus have been developed independently. Energy law and policy in the United States have largely been dominated by the paradigm which fosters the fossil fuel consumption. Environmental law and policy, which was supposed to control the environmental effects due to the energy consumption, lacked any policy linkages to consider the energy use due to its own limitation in logic and regulation. Several legislative attempts at the U.S. Congress to regulate the carbon emissions as well as to regulate energy use were not successful. However, some cases to seek remedy before the court appeared in recent years. In addition, a growing number of state governments lead to enhance the use of renewable energies and to increase the energy efficiency. Renewable Portfolio Standards (RPS) system in particular is a noteworthy instrumental development in combining the energy use and the environmental effects, along with the emission trading system.
