Web 2.0 시대의 민사법적 과제

A Study of Civil Law in the Age of Web 2.0 - Focusing on Damages Liability -

인터넷 상의 온라인서비스제공자(OSP: Online Service Provider)는 현대의 사회 및 경제 분야에서 매우 중요한 역할을 하고 있다. 인터넷 상에서 무수한 OSP들이 운영되고 있으며, 그 서비스를 이용하는 이용자들의 수와 이용량도 상상하기 어려울 정도로 많으며, 계속적으로 증가하고 있다. 그런데 이러한 OSP의 역할이 종래와 같이 단순히 정보나 서비스의 중개 역할에 머무르지 않고 보다 적극적으로 스스로 정보나 서비스를 제공하는 역할도 하고 있으며, 단순한 중개자가 아니라 인터넷 세상에서 매우 중요한 위치를 점하고 있다. 이에 인터넷이 처음 보급 되던 때에 OSP의 중립적 입장을 고려하여 책임을 제한하려던 흐름으로부터 변화되어 최근에는 OSP의 책임을 확대하려는 논의도 생겨나고 있다. 이러한 흐름속에서 OSP의 책임이 명확하게 어느 정도까지여야 하는가의 물음에 대하여 과거 외국법제가 활발하게 소개되고 입법론이 제시된 후로 구체적인 논의나 방향등에 대하여 지속적으로 논의가 발전되지는 않은 듯 보인다. 더욱이 손해배상책임의 기본적인 법리를 제공하는 민법과의 조화로운 해석 및 입법론에 대하여도 상세하게 논의되지 못한 면도 있다. 이러한 반성을 바탕으로 하여 이 글에서는 먼저 OSP의 손해배상책임의 명확화라는 목표를 바탕으로 하여 Ⅱ.에서 외국의 OSP의 책임의 제한에 관한 입법례를 살펴보고, Ⅲ.에서는 우리 법상 손해배상책임의 발생 구조와 유형, 구체적인 요건과 책임제한에 관한 규정, 그리고 OSP의 손해배상책임에 관한 판례의 동향을 살펴본 후, Ⅳ.에서는 외국 입법례와 국내관련 규정의 비교 및 검토를 바탕으로 향후 법제 정비의 방향에 대하여 제언을 시도하였다. 특히, 입법론으로서 책임제한의 대상이 되는 OSP의 범위를 구체적 으로 한정하고, 책임제한도 필요적 감면(혹은 감경)으로 개정할 것을 제안하였다.

Online Service Providers are playing a key role in the age of Web 2.0. Especially, so-called “Portal Site” gives a huge effect to our society and economy. According to the change of role in the society, the degree of liability of online service provider by third parties’ illegal acts is getting higher. At least, expectation level of society on the liability of OSP seems to be considerably high. So, legislators have tried to make laws for protecting internet users. On the other hand, it’s necessary to make a provision on the limitation of OSP’s liability at the early days because of development of business. But, Korean Supreme Court decided that OSP is liable on distribution of news including contents infringing other’s right because it selected and arranged news provided by several newspaper companies. However, the court decision and the present provision on liability limitation are a little bit questionable. This thesis tries to give an legislative opinion. Consequently, it is necessary to concretize the concept of OSP, and change optional mitigation and remission of liability in the existing law into mandatory exemption of liability through legislation.
