A Study on the Establishment of Korea-China Joint Crime Control Organization

With a view to preventing in advance transnational crimes increasing recently and cope with them effectively and promptly, it is necessary to consider seriously the establishment of International Crime Control Organization among North East Asian countries through multilateral agreement or treaty. This paper proposes the establishment of a Joint Crime Control Organization as a strategy to secure public security between Republic of Korea( Korea ) and People s Republic of China( China ). As actual border lines disappear these days, the Joint Crime Control Organization as a permanent organization may provide foundations to secure public security among Asian countries. Since transnational crimes are expected to increase in North East Asia, it is necessary to establish the Joint Crime Control Organization that covers East Asia region including the North East area. The Joint Crime Control Organization will make up for the weak points of international judicial assistance in criminal matters based on bilateral agreements, and help to establish a more effective judicial assistance organization. However, traditional responses to transnational crimes such as extradition, international judicial assistance in criminal matters, and assistance system through INTERPOLE, are partly effective. The Joint Crime Control Organization should be established in East Asia as a data collection and processing organization to prevent and eliminate transnational crimes, while maintaining the existing structure of extradition and judicial assistance in criminal matters. Therefore in short term it is necessary to establish an Intermediate-type Joint Assistance System that is one step advanced from the current international judicial assistance in criminal matters but not a permanent Joint Crime Control Organization. In this context, it is desirable to discuss methods for establishing data network that can effectively and promptly notify data on transnational crimes to and share them with intelligence and investigation organizations of each country in North East Asia. With respect to the establishment of the Joint Crime Control Organization, Korea may play a role of a mediator between China and Japan by emphasizing geopolitical advantages to set up the headquarters of the Joint Crime Control Organization in Korea.
