A Study on Some Legal Issues of Computer Cookies

Cookies are small text files that can be placed on computer hard drive when a computer user visits a particular web site. The cookies are used for tracking specific information about users, such as site preferences. Cookies are very beneficial to an internet-user, saving his password and ID to quicken his login. Cookies are also useful to the company which wants to collect marketing research and to develop advertising techniques. The online advertisement company using the personal information puts an advertisement in an internet user s computer. Cookies would be the tool which invade the privacy of an internet user. Therefore, it is one of the most important problems to protect the privacy of an internet user nowadays. Although current Korean laws do not directly regulate the use of personal information, there are several norms which indirectly regulate the cookies. This treatise deals with the legal problems of computer cookies. In this treatise I would like to advance a theory to regulate legal problems rationally arising from computer cookies. This treatise deals with not only the duty of a notification about the cookies , the consent of an internet-user(the consent can be revoked at any time in Korea) , the access right to the information gathered through cookies , the right of rectification , etc., but also the claim for damage(A nonfulfillment of obligation and/or an unlawful act would come to the cause of this claim.) and the injunction in case that the individual information would be infringed .
