비시가화지역 관리수단으로서 성장관리방안의 실효성 및 개선방안

The Effectiveness and Improvement Measures of the Growth Management Plan as Managing means of Non Built-up Areas

비시가화지역의 난개발 방지를 위한 정책으로 2013년 7월 성장관리방안이 법제화되어 최근 세종시와 화성시에서 관련 계획을 수립하여 고시했다. 본 연구는 그동안 비시가화 지역을 관리하는 다른 제도와 비교할 때 성장관리방안 수립의 장·단점이 있는지와 수립 사례를 분석한 후 전문가 인터뷰(FGI)를 통해 제도적 유의성 및 개선이 필요한 분야를연구했다. 연구결과 성장관리방안은 기반시설 및 건축물의 배치ㆍ형태, 환경·경관계획을 미리계획한 후 허가를 유도하는 선계획-후개발 시스템을 갖출 수 있고, 지역 및 개발형태가 고려된 비시가화지역의 특성에 따라 유연한 계획을 수립할 수 있으며, 재정투입이 없는 상태에서도 비시가화지역을 지구단위계획 체계와 유사한 수준으로 관리할 수 있다는 데장점이 있는 것으로 분석됐다. 다만, 기반시설의 공급 및 배치에 대한 기준이 미흡하므로 배치기준을 구체화할 필요가 있으며, 성장관리방안의 제도적 위상이 불분명한 위치에 있고 법률적 구속력이 없어 위법행위 관리의 한계와 인센티브 기준이 현 수준으로는 개발행위에 기대할만한 수준이 아니므로 개선이 필요한 것으로 검토됐다.

As a policy to prevent the urban sprawl of non built-up areas, the Growth Management Plan was enacted by MOLIT(Minister of Land, Infrastructure and Transport) in July 2013, and more recently the supplementary plans were established in Sejong City and Hwaseong City. This study analyzed the ‘Pros’ and ‘Cons’ of establishing the Growth Management Plan, and the established cases. Compared to other existing statuary planning that manage non built-up areas, the study investigated the effectiveness of the areas for improvement, using an expert interview(FGI: Focus Group Interview). As a result of the analysis, the Growth Management Plan plans the infrastructure and buildings layout and form, environment, landscape in advance. Then it can have a pre-planning and post-development system that lead to obtain permission. And it establish a flexible approach to the development depending on the nature of non built-up areas by considering a regional development plan. There are advantages of managing non built-up areas similar to the district-planning system in the absence of financial input. However, the infrastructure provision and supply standards are insufficient, so it is necessary to specify the layout standards. The institutional factors of the Growth Management Plan is unclear. And there is no legal barrier, so it is necessary to improve standards that the limits of illegal act management and the incentive standards are not at the level of the expected development activities at present.
