부양의무에 대한 법적 성격 고찰

A Study on Legal Characteristics of Family Support Obligation : Focusing on Civil Law and the National Basic Livelihood Security Law

본 연구의 목적은 부양의무의 개념과 부양의무자 기준에 대해 민법과 국민기초생활보장을 통해서 검토하고, 생활보호법 제정 당시로부터 현행 국민기초생활보장법까지 제도 변화의 역사적 과정에서 부양의무자 기준의 변화를 살펴봄으로써, 현재의 부양의무자 기준의 적합성을 검토하고자 한다. 그리고 사회적, 경제적, 인구학적 구조의 변화에 따른 부양의식의 변화, 부양실태의 변화 등을 살펴보고, 부양의무자 기준을 둘러싼 부양의무자의 범위와 이에 따른 사각지대, 부양능력 판정, 부양비의 문제점 등을 진단하고자 한다. 민법과 생활보호법에서 국민기초생활보장법에 이르기까지 부양의무의 법적 성격과 부양의무 자의 기준에 대해 법적으로 검토하였다. 첫째, 부양의무자 조건으로 인해 수급자격을 상실하거나 사각지대에 남아있게 된다. 둘째, 부양의무자는 소득과 재산기준 모두를 충족해야 하므로 부양능력 판정기준이 비현실적이다. 셋째, 간주부양비를 지불해야 할 의무가 있는, 빈곤한 부양능력 미약자 집단에게 부양을 강제하는 것은 빈곤의 재생산을 초래한다. 마지막으로 친족간의 광범위한 부양의무를 지게 하는 것은 사적부양의 범위를 지나치게 확대하는 것이다. 국민기초생활보장법의 시행에 있어서 부양의무자 기준 개선을 위한 제언은 다음과 같다. 부양의무자 기준 적용을 폐지하여 노인빈곤과 사각지대에 대한 문제를 해결할 수 있도록 하고, 최저생계비의 130%로 되어 있는 현행 부양능력 판정기준을 상향조정하며, 간주부양비를 폐지하고, 민법상의 부양의무자 기준을 조정해야 할 것이다.

The study examined legal characteristics of family support obligation in Civil Law and the National Basic Livelihood Security Law(NBLSL). Family support attitude and consciousness have changed through development of modernization, industrialization, and urbanization. This study reviewed legal revisions and changes of family support obligation in Civil Law and Livelihood Protection Law (LPL) to NBLSL. This analysed change of family support obligation rules, scope of family support obligation, determination rules of family support ability, and regarded maintenance cost. As a result of evaluating the legal characteristics and adequacy of family support obligation rules, this study s suggestions are followings. First, if family support obligation rules is abolished, it is useful to solve the aged poverty, and the blind spot. Second, it should raise determination rules of family support ability above the minimum cost of living s 1.3 times. Third, regarded maintenance cost should be repealed because the weak family support ability group can t afford to support other family members, and they may reproduce poverty. Finally, it needs to coordinate family support obligation in Civil Law.
