A Study on Social Right and Relief for Legal Right

본 연구는 사회복지수급자의 침해된 권리를 보장하고 복지를 향상시키기 위해, 사회적 기본권에 대한 제 학설들과 헌법상 규정된 사회적 기본권의 조항들을 검토한다. 사회복지법의 권리구제 조항들을 분석하여, 사회복지법들의 권리구제의 문제점과 개선방안을 탐색하고자 한다. 사회보장기본법, 사회보험법, 공공부조법, 사회서비스법 등의 권리구제 조항들을 분석한 결과는 다음과 같다. 첫째, 사회보장기본법은 권리구제 조항이 구체적으로 마련되어 있지 않은 반면에, 사회보험법은 권리구제 조항과 절차가 구체적으로 마련되어 있어 사회적 기본권의 권리를 실현하고자 했다. 사회복지사업법은 권리구제 조항이 부재하였고, 사회서비스법은 일부 법률만이 권리구제 조항을 두었다. 둘째, 개별 사회복지법마다 권리구제 조항이 상이하게 규정되어 있어 법의 통일성과 일관성이 부족하다. 즉, 권리구제 절차, 권리구제 청구기간, 심사청구 결정기간 등에서 차이가 있다. 따라서 사회복지법 상의 권리구제 조항의 신설, 권리구제 절차와 내용의 구체적인 규정을 통한 실체적 권리의 제도적 보장이 필요하다. 마지막으로 사회적 기본권의 구체적 실현을 위하여 사회복지와 사회보장의 개념 정의, 사회서비스와 사회복지사업의 개념 정의가 재고될 필요가 있다.

This study examined social welfare legislations regarding social right and relief. Social welfare law includes Framework Act on Social Security, social insurance law, public assistance law, social service law. Each law does have diverse version of relief for legal right, so it lacks consistency. Social Right of Framework Act on Social Security and Social Welfare Service Act does not include relief for legal right. The parts of social service law include some items regarding relief for legal right, but do not include process for relief for legal right. Only social insurance law includes relief for legal right and its process. The study examined the relief for legal rights on social welfare legislations. In addition, each law does have different due process, appealing period, decision due date for appealed case for relief for legal right. Therefore, social welfare law should include relief for legal right and provided concrete process and regulations for it. Furthermore, it is time to redefine definition of social welfare and social security, social service and social welfare services.
