경찰의 헬리콥터 운용에 관한 연구:

A Study on Police Helicopters Operation: Application of Related Laws and Comparison of Foreign Usage

본 연구는 경찰청에서 운용하는 헬리콥터의 주요 임무 내용과 문제점을 파악하고 개선방안을 제언하기 위하여 수행하였다. 이 연구 목적을 달성하기 위하여 최근 3년(2014～2016)간 전국 12개 지방경찰청의 임무 실적을 파악하고 치안 현장에 미치는 경찰항공의 중요성을 확인하였다. 그리고 선진 5개국(미국, 영국, 프랑스, 일본, 러시아 등)들의경찰항공 운영 조직과 규모를 파악ㆍ비교하여 우리나라 현실의 몇 가지 개선 및 발전사항을 확인하였다. 첫째, 국제항공법과 우리나라 항공 법의 적용 차이 개선. 둘째, 노후 헬리콥터들의 조속한 교체 필요. 셋째, 경찰 장비에 대한 고의적 가해자의 현실적 처벌 필요. 넷째, 드론 및 초경량 항공기와의 공중 공간분리와 항공관제 필요. 다섯째, 경찰 전체에 약 30여 대의 헬리콥터가 필요하다는 것이다. 경찰 헬리콥터는｢경찰관 직무집행법｣(법률 제 13825호 2016.1.27. 일부개정)에 근거하여 ｢통합 방위법｣, ｢재난 및 안전관리 기본법｣, ｢경찰항공 운영규칙｣(경찰청 훈령 제722호)등을 기본으로 운영하고 있다. 특히 치안현장에서 통 합방위 및 대테러작전, 중요범인 추적 및 실종자 수색과 교통관리 임무는 경찰 헬리콥터가 주ㆍ야간에 수행하는 경찰의 고유 임무이다. 따라서 본 연구는 경찰항공이 수행하는 치안현장의 필요성과 개선방안을 제시했다는 점에 그 의의가 있으며 차후 법률, 장비, 인사 담당자들의 지속적인 관심이 필요한 분야이다.

The purpose of this study is to investigate the main tasks and problems of the helicopter operated by the National Police Agency and to propose improvement plans. In order to accomplish this research purpose, the accomplishments of 12 provincial police departments across the country were identified during the last three years (2014～2016), and the importance of police aeronautics on the police field was confirmed. In addition, we have identified some improvements and developments in Korea s reality by comparing and analyzing the size and size of the police aviation operations of the five developed countries (US, UK, France, Japan, Russia, etc.). First, the application difference between international aviation law and Korean aviation law improved. Second, the need for early replacement of old helicopters. Third, the need for punitive punishment of willful perpetrators on police equipment. Fourth, air space separation and air traffic control between drones and ultra light aircraft. Fifth, about 30 helicopters are needed throughout the police force. Police helicopters are based on the Unified Defense Law, the Disaster and Safety Management Basic Law, and the Police Air Operational Regulations(Police Agency Directive No. 722), based on the Police Officer s Duty Execution Act (Law 13825, Feb. 27, 2016). In particular, integrated defense and counterterrorism operations, critical criminal tracking, search for missing persons, and traffic management missions in the security field are police officers specific tasks in police helicopters during the day and night. Therefore, this study was meaningful in that it presented the necessity and improvement plan of the security field performed by the police aviation and future legislation, equipment, and human resources are in need of constant attention.
