무과실책임주의에 기반한 학교안전사고 예방 모형 수립을 통한 학교안전정책 선진화 방안 연구

A Study on the Advancement of School Safety Policy by Establishing School Safety Accident Prevention Model Based on No-Fault Liability Principle

이 연구는 사고 발생 원인과 예방에 관한 기존 이론을 검토한 후 무과실책임주의에 기초하여 책임 주체들의 과실(부주의)을 초래한 원인을 규명함으로써 사고 예방정책 모형 수립을 목적으로 한다. 책임 주체들의 과실(부주의)에 기초한 일반적인 학교안전사고와 학교 외적 요인의 재난사고로 구분하여 각각에 대한 예방 대책을 제시함으로써 학교안전정책 추진에 관한 업무체계(framework)를 제안한다. 이러한 업무체계에 기초하여 법령, 교육부 정책의 성과와 한계를 비판적으로 검토함으로써 학교안전정책의 선진화 방안을 제시한다.

The purpose of this study is to establish an accident prevention policy model by reviewing the existing theories about cause and prevention of accidents and by identifying the cause of the negligence of the responsible parties based on no-fault liability principle. We propose a framework for the promotion of school safety policy by classifying them into general school safety accidents based on negligence of the responsible parties and disaster accidents of external factors. Based on this work system, we propose a plan to improve the school safety policy by critically reviewing the performance and limitations of the laws and the Ministry of Education policy.
