국제장애인권리조약의 의의와 한계

Implications and Limitations of ‘International Convention on the Rights of Persons with Disabilities’: A Discussion on the Social Exclusion of Persons with Disabilities

본고는 국제장애인권리조약이 장애인의 사회적 배제 극복과 관련하여 가지는 의의와 한계를 검토하고자 하였다. 기존의 빈곤 개념과는 달리 역동적이고 다차원적이며, 시민적 권리가 강조되는 사회적 배제의 관점으로 장애 문제를 조명해보고 이에 대한 대안을 모색해보는 것은 그동안 이루어져왔던 기존의 접근방법이 가지는 한계를 극복하는데 도움이 될 것으로 생각된다. 이러한 맥락에서 현재 진행 중에 있는 국제장애인권리조약의 추진 과정 및 내용을 검토해 봄으로써 장애인의 진정한 사회 통합(social inclusion)을 위한 출발점으로서의 가능성을 탐색해 보았다. 국제장애인권리조약은 장애인의 인권에 대한 기존 접근방법의 한계와 비판에서 출발함으로써 그 추진과정에서 장애인 당사자들의 목소리를 담아내고자 하였으며, 그동안 간과되었던 사회 환경의 변화를 목표로 하고 있다는 점에서 그 의의를 찾을 수 있다. 하지만 장애인의 사회통합을 이루기 위한 직접적인 영향을 미치기 위해서는 아직 해결해야 할 과제들이 많이 남아 있는 것 역시 부인할 수 없다. 이는 국제조약이 가지는 구속력이나 효력의 한계와 관련된 것으로서 이에 대한 보완을 위한 제도적 장치 마련이 필요하다고 볼 수 있다. 또한 국제장애인권리조약에서 규정하고 있는 내용들의 구체적 실현을 위한 정책이나 제도, 법 등의 제정 역시 뒤따라야 할 것이다. 이러한 한계점에도 불구하고 국제장애인권리조약은 장애인들의 진정한 사회통합을 위해 장애인 정책이나 제도가 지향해야 할 바를 제시해줄 수 있다는 점에서 그 의의를 찾을 수 있을 것이다.

This paper attempts to examine implications and limitations which ‘International Convention on the Rights of Persons with Disabilities’ has in relation to social exclusion of persons with disabilities. Social exclusion, a new concept or paradigm that replaces the concept of poverty, has been accepted and applied for social policy in Europe. There are differences between poverty and social exclusion in that the latter is dynamic, multidimensional, and right-based. Therefore, it can be meaningful to analyze problems of person’s with disabilities and to try find a solution to the problems through the perspective of social exclusion, especially in overcoming limitations of existing solutions. The term ‘social exclusion’ was used to refer primarily to those who slipped through the social insurance system in France. However, its meaning has been extended to be related to civil rights. The concept ‘social exclusion’ is understood as violating or not ensuring basic rights of citizen and the protection for the rights is sought as a solution for social exclusion. In this context, this study explores the possibility of ‘A Comprehensive and Integral Convention on Promotion and Protection of the Rights and Dignity of Persons with Disabilities’ as a starting point for social inclusion of person’s with disabilities. In the process of discussion for the convention, efforts to reflect the opinions of persons with disabilities. In addition, the convention targets social and environmental changes that have been underemphasized. We can find significance and meaningfulness of the convention in such efforts and purposes. However, there are many problems to solve to achieve social inclusion based on the convention. Those problems are associated with limitations of enforcement which international conventions generally have. Thus, the supports of institutional system is needed to overcome such limitations. It is also needed to establish institutions, policies, and laws to realize the contents and purposes of the convention. Despite such limitations, we can find the significance of the convention in that it suggests the direction or goal that the disability policy and institution should pursue for social inclusion of person with disabilities.
