사이버대학교 특수대학원설립기준의 불평등성과 개선방안

Cyber graduate school authorization standards: A comparison with other graduate school authorization standards

2001년 설립된 사이버대학교가 2008년 고등교육법의 개정을 통해 고등교육기관으로 전환되면서 대학원설립에 대한 논의가 진행되었다. 이에 따라 2009년에 특수 대학원설립평가가 이루어졌으며 이 기준에 의해 최초로 사이버대학교 특수대학원인 한양사이버대학교 대학원이 설립되었다. 사이버대학교의 대학원은 일반 대학교 및 방송통신대학교의 특수대학원과 같은 법률상의 지위를 가지고 있다. 그러나 사이버대학교가 특수대학원을 설립하고자 하는 경우에는 일반 대학교나 방송통신대학교의 대학원설립과는 다른 규제를 받도록 설립기준이 되어 있다. 사이버교육의 특성이나 질관리의 문제로 인해 별도의 규제 기준을 두는 것은 합리적 차별이라고 할 수 있지만 현재의 규제내용 중 교원 등에 관한 기준은 합리적 차별을 넘어 평등권을 침해한다고 해석할 수 있다. 현재 사이버대학교 대학원설립기준에 의하면 해당 대학원학과에 3명의 전임교원을 두어야하고 전임교원에 대한 연구역량, 교육경력, 과목적합성 등을 평가하도록 되어 있지만 오프라인대학교의 특수대학원설립기준은 관련학부에 3명의 전임교원이 있으면 대학원을 설립하도록 하는 등의 차별이 주어져 있다. 특수대학원의 교육질확보와 평등권보장을 위해서 사이버대학교의 대학원설립기준을 오프라인대학교의 특수대학원설립기준에 적용하도록 하는 것이 타당하다. 이는 동일한 목적을 위해 유사한 수단을 사용하는 집단에 대해 평등한 규율체계를 적용 한다는 실질적 평등을 이루는 방법이며 교육의 사회적 책임을 강화하는 것이다.

This study examines the policy issues surrounding the horizontal regulatory system of graduate school authorization standards (2009) by the Ministry of Education and Human Resources Development (now the Ministry of Education). The Higher Education Act has been amended to add Cyber University as a higher educational institution. Therefore, Cyber University is now allowed to form a special graduate school. In Korea, it is necessary to obtain authorization to establish a graduate school. The Cyber graduate school authorization standards provide requirements for establishing a graduate school: three faculty in full service, minimum research performance evaluation standards, and lecturer standards. Cyber graduate school authorization standards is discriminatory act of violating the equal right, but it is not law that ought to be abolished. It is my contention that the Ministry of Education apply the Cyber graduate school authorization standards to off-line universities and to Korea National Open University.
