Foucault의 파놉티콘 개념에서 본 어린이집 CCTV 의무화에 대한 비판적 이해

A Critical Understanding of Mandatory Installation and Operation of CCTV in Child-care Centers: Focusing on Foucault’s Panopticon Concept

이 글은 아동보육시설에서의 각종 안전사고 및 아동학대 예방을 목적으로 하는 CCTV 설치및 운영의 의무화를 비판적으로 검토하려는 목적을 가지고 있다. 이를 위해, 이 글은 어린이집 CCTV 설치 및 운영의 의무화가 추진된 과정을 탐색하고, CCTV 설치 및 운영을 둘러싼 쟁점을 ‘효과성’과 ‘인권’의 문제를 중심으로 분석하였다. 이어서 Foucault의 파놉티콘 개념을 중심으로 어린이집에 설치･운영되고 있는 CCTV의 메커니즘을 권력 효과의 관점에서 분석하고, 이에 내재된 감시와 처벌의 원리를 탐색하였다. CCTV 설치 및 운영 의무화는 교사 스스로 자기감시와 자기 통제를 내면화하고, 학부모와의 비정상적인 권력 관계를 형성함으로써 교육에 대한 심각한 침해를 야기한다는 점에서 비판적으로 검토될 필요가 있다.

The purpose of the article is to critically review the discussion on mandatory installation and operation of CCTV for preventing various accidents and child abuse in child care facilities. For this purpose, the study explores the legalization process of CCTV installation and operation in Korea, and analyzes the issues surrounding the CCTV regulation in light of ‘effectiveness’ and ‘human rights.’ The study also investigates the mechanism of CCTV and the principle of inherent monitoring and punishment, focusing on Foucault’s notion of panopticon. The mandatory installation and operation of CCTV needs to be critically examined as teachers themselves internalize their own surveillance and self-control, and it causes serious violations of education by forming distorted power relations with parents.
