Measures to Establish a Land Registration System in North Korea after the Reunification of the Korean Peninsula

원래 한반도 모든 지역에서 토지소유제도와 토지등기제도는 동일하였지만, 8·15해방 이후 남·북한으로 분단됨에 따라 북한지역은 남한지역과는 완전히 다른 토지소유제도와 토지등기제도를 가지게 되었습니다. 따라서 통일 이후 북한지역에서 토지등기제도를 수립하는 문제는 상이한 남·북한의 토지등기제도를 다시 통합하는 과정이라고 볼 수 있고, 이를 위해서는 지금부터라도 미리미리 충실하게 준비해 두어야 합니다. 이러한 문제의식에서 본 연구보고서는 통일 이후 북한지역에서 토지등기제도를 수립하기 위한 방안을 다루었습니다. 통일 이후 북한지역에 마련할 토지등기제도를 고안하기 위해서는 먼저 현재의 남·북한 지역의 토지소유·이용제도 및 토지등기제도를 파악해야 할 것입니다. 따라서 제2장에서는 남·북한 토지제도의 변천 및 현황을 소개하였고, 제3장에서는 남·북한 토지등기제도의 현황을 살펴본 후 양 제도를 비교하였습니다. 다음으로, 제4장과 제5장에서는 통일과정에서 토지등기제도를 수립할 때 상정할 수 있는 일반론 및 외국에서의 구체적인 경험과 시사점을 차례로 다루었습니다. 특히, 제5장에서는 총 8개국의 사례를 ‘분단국가에서 통일을 이룬 국가’, ‘계획경제에서 자본주의 시장경제체제로 전환한 국가’, ‘계획경제에서 사회주의 시장경제체제로 전환한 국가’ 등 3가지로 유형화하고, 이들 각국의 토지등기제도 재편과정을 살펴봄으로써 유익한 시사점을 얻고자 하였습니다. 이어서 제6장에서는 우리나라가 처한 특수성을 살펴보고, 그에 맞추어 통일 한국에서 토지등기제도를 수립할 때 특히 고려할 사항에 관하여 검토하였습니다. 마지막으로 제7장에서는 통일 이후 북한지역 토지등기제도의 구체적인 수립절차 및 관련 쟁점을 다루었습니다. 여기서는 토지등기제도 수립의 전제가 되는 지적제도의 통합, 등기사항의 결정, 등기신청절차의 정비, 물적·인적 등기인프라의 구축 등을 살펴보았고, 이를 종합하여 등기제도 수립을 위한 구체적인 추진방안을 정리해 보았습니다. 이를 통해 통일 이후 북한지역 토지등기제도의 구축을 위한 로드맵을 제시하고, 그 과정에서 발생하는 관련 쟁점을 파악·해결하고자 하였습니다. 본 연구는 통일에 대비한 토지등기제도 구축에 필요한 실행계획을 제공한다는 측면에서 중요한 의의가 있습니다. 아무쪼록 이를 계기로 앞으로 더욱 심도 있는 논의가 이루어져서 관련 후속 연구가 활성화되고, 실제로 통일 이후 북한지역에 토지등기제도를 수립하는데 조금이나마 도움이 되기를 기대합니다.

Originally there existed but one system of the land ownership and land registration system throughout the whole Korean peninsula, but since Korea was divided into two areas after the 8·15 independence, North Korea has had completely different land ownership and land registration system from that of South Korea. How to reestablish the land registration system in North Korea after the reunification of the Korean peninsula is a matter of integrating the different land registration systems of South and North Korea into one. For this, we have to be prepared enough in advance. In this respect, this research report presents the detailed measures to establish the land registration system in North Korea area after the reunification of Korea. First, the current land ownership and land registration system in both South and North Korea area should be understood. Chapter 2 introduces the histories and current situations of land system in South and North Korea, and chapter 3 compares the difference of land registration systems in South and North Korea after taking a look at the histories and current situations of both countries. Next, chapter 4 and 5 present the general principles that can be assumed in the process of establishing a new land registration system after the reunification as well as case studies in other several countries. Chapter 5, in particular, classifies the cases of 8 countries into 3 types, such as the country reunified from two separate entities, the country where planned economy system was transformed to capitalistic market economy system and the country where planned economy system was transformed to socialistic market economy system. And by reviewing the process of restructuring the land registration system in these countries, we can get some useful implications. Then, chapter 6 refers to the special circumstances of the Korean peninsula and some considerations in case of establishing the land registration system in the reunified Korea. Finally, chapter 7 deals with the specific procedures and related issues for restructing the land registration system in North Korea area after the reunification. In this chapter, the specific action plans to establish the land registration system are discussed in details such as the integration of cadastral system, the decision of registration details, the improvement of the registration application procedure, and the installation of registry offices and strengthening the competence of registration officers. This research attempts to suggest a roadmap to quickly establish the land registration system in North Korea after the reunification and solve the related issues inevitably arising in this process. This research is significant in terms of providing the practical action plan for a new land registration system in preparation for the reunification of Korea. Hopefully this research can serve as a stepping stone for subsequent researches in the future.
