미국 행정법판사제도에 관한 연구

1985년 행정심판법의 제정 이래로 우리나라 행정심판은 국민의 권익을 보호하는 구제절차로서 그 기능을 강화해 오고 있습니다. 1985년 74건에 불과했던 청구 건은 2014년에는 25,301건으로 크게 증가하였습니다. 행정심판의 권리구제 기능이 확대됨에 따라 행정심판이 공정한 실질적 적법절차로 자리매김할 수 있도록 다양한 연구를 수행하는 것이 필수적이라 하겠습니다. 미국은 행정절차에서 적법절차를 확보하기 위하여 행정법판사라는 신분을 법적으로서 보장하고 이들로 하여금 법에 따라 공식적(formal)인 행정심리를 진행하도록 하고 있습니다. 이 보고서는 미국 행정법판사의 자격, 자질, 업무, 독립성, 윤리 및 징계 문제, 협회활동 등 미국의 행정법판사제도에 관하여 차례로 살펴본 후, 미국 행정법판사제도가 우리나라에 줄 수 있는 시사점을 찾고자 하였습니다. 미국행정법판사가 하는 업무에 대한 충분한 이해를 할 수 있도록 각 연방 및 주 행정부에서 미국 행정법판사가 하는 행정심리의 절차를 연구하였으며, 행정법판사가 받는 교육 및 행정법판사들을 위한 지원인력에 대하여도 고찰하였습니다. 또한 현재 문제가 제기된 바 있는 연방 증권거래위원회 행정법판사 위헌성 문제에 대하여도 간단히 검토하였습니다. 본 보고서를 통하여 미국행정법판사제도 현황에 대한 충분한 이해를 바탕으로 법조일원화시대에 민주주의의 근간이 되는 법치주의가 실질적으로 구현될 수 있도록 다양한 관점에서 정책설계에 대한 고민이 시작되기를 기대해 봅니다.

With Korea gaining competence in protecting its citizens’ rights against administrative actions, conducting respective scientific studies becomes a prerequisite in order for the substantive due process to be now firmly rooted. This research embarks on one of such needful studies with a recognition that the United States has established its own unique system of administrative law judges, giving persons who conduct formal hearings within the administrative agencies certain protections under the law to guarantee due process. After having studied its qualifications, competences, duties, independence, ethics, dis- cipline, and its rofessional associations, this research found some constructive lessons from the system. For better illustration, further deepened examinations of the hearing proc- esses, continuing legal education, and support personnel of the administrative law judges both federal and state-wise, were conducted. In addition, the recent challenges against the constitutionality of Securities Exchange Commission’s administrative law judges have been briefly reviewed. This research may be able to provide readers with an insight into the development of sustainable rule of law in the new legal regime which Korea will face, as written with such desire.
