킹던 (Kingdon) 의 정책흐름모형을 적용한 재한외국인처우기본법의 정책형성과정 연구

A Study on the Policy Formation Process of the Basic Act on the Treatment of Foreign Residents in Korea - Focusing on the Kingdon s Policy Stream Model -

본 연구는 재한외국인 사회통합제도 도입이란 정치적 이슈가 정부의제를 거쳐 재한외국인처우기본법 제정으로 채택되는 정책형성과정에 대해 Kingdon의 정책흐름모형을 적용하여 초점사건과 정책선도자의 역할, 그리고 세 가지 흐름의 결합 (coupling) 이 어떤 형태로 나타나 정책의 창 (policy window) 이 열리게 되었는가를 분석함으로써 정책적 시사점을 제공하는데 그 목적이 있다. 본 연구는 복잡한 이해관계와 민감한 정치적 이슈를 정책형성과정의 흐름을 통해 분석하였으며, 특히 정책결정과정에서 킹던의 주장처럼 정책선도자인 최고 정책결정권자의 적극적인 역할과 비공식 참여자보다는 법무부 고위관료 등 공식적 참여자의 역할이 더 중요하다는 사실을 확인하는 등 이론을 검증함으로써 정책사례의 적용가능성을 확대하였다는 점에서 의의가 있다.

This study aims to examine the policy formation process adopted by the Basic Act on the Treatment of Foreign Residents in Korea, which is based on the political issue of the government, through the framework of Kingdon’s Policy Stream Model. The purpose of this paper is to provide policy implications by analyzing the roles of both the focusing event and political leaders and how the coupling of the three policy streams combined to open the policy window. This study analyzed the complicated interests and sensitive political issues through the policy formation process. In particular, this paper confirmed the Kingdon’s conclusions by finding that in terms of the political decision making process, the active role of top decision makers such as policy entrepreneur and the role of official participants such as senior officials of the Ministry of Justice. This is significant in that it extends the applicability of the policy case study by verifying the theory that the role of political leaders is more important.
