이 논문은 2017년 선고된 인보험판결 중 중요하다고 생각되는 판결의 내용을 요약하고 이에 대하여 간략한 코멘트를 덧붙인 것이다. 수집대상은 보험계약법 총칙과 인보 험편 판결을 주된 대상으로 하였다. 아울러 손해보험판결 중에서 인보험에 대하여도 의미를 지닌다고 보여 지는 일부 판결을 포함하였다. 나아가 보험법 영역을 떠나 생명보험 산업과 관련이 깊은 일부 판결도 포함하였다 한편 민원이 집중되는 금융감독원 금융분쟁조정 사례 는 최근 법원에 의하여 인용(引用)되는 경우가 있고 업계 실무자들에게도 큰 영향을 미치고 있는데, 본고에서는 인보험 조정사례를 살펴보았다. 한편 개인정보보호정책이 강화되면서 판결에 대한 접근이 제한적이어서 모든 판결을 망라하지는 못하였다.
This paper summarizes the issue of the judgment that is deemed important among the personal insurance decisions sentenced in 2017, and adds a brief comment thereof. The main object of the collection were the general provisions and personal insurance provisions of the insurance contract law. However, some of the non-life insurance decisions that have significance for the personal insurance contract were included. It also contained some rulings related to life insurance industries. Not all cases were comprehensive because judgment access, such as privacy, was restricted. This paper also introduced some mediation cases of the Financial Supervisory Service.
