부동산 중개사고 유형에 따른 사고방지방안 분석에 관한 연구

Analysis on the Preventive Action by Real Estate Brokage Accident Type

본 연구는 부동산 거래를 보호하기 위해 중개과정별로 발생하는 중개사고의 유형과 방지안을 법원판례와 설문조사를 통해 분석하고 중개사고 방지안에 대한 중요도를 도출하였다. 분석결과, ‘계약이행’단계, ‘중개의뢰’단계, ‘물건분석’단계, ‘고용인의 불법행위’가 사고발생이 높은 중개과정으로 나타났고 사고방지방안에 대한 중요도는 ‘중개실무자에 대한 교육강화’, ‘중개대상물 확인·설명 서식 개선’, ‘공제한도액 상향’, ‘부동산등기의 공신력 부여’ 등의 순으로 높게 나타났으며 이를 주거용 및 비주거용으로 구분하여 차이점을 분석하였다. 본 연구결과가 중개사고 방지를 위한 근거로 활용되어 부동산 거래질서를 확립하고 시장의 신뢰성을 공고히 하고자 한다.

CONTENTS (1) RESEARCH OBJECTIVES This study aims to identify the type of real estate accident classified by the brokerage stage and define the weight level of real estate accident prevention items towards the feasible implementation. (2) RESEARCH METHOD The accident types have been analyzed by the precedent of lawsuits and expert surveys on the brokerage stage. And the accident prevention items have been identified based on prior literature review and the weight for prevention items have been developed based on the AHP methodology by 40 experts survey. (3) RESEARCH FINDINGS Research finding indicates the ‘contract performing’, ‘brokerage request’, ‘property analysis’ stages are vulnerable for accident, and that the important criteria for accident prevention are different by the perspective of experts. 2. RESULTS This study proves that the real estate brokerage should be improved for the accident prevention with focus on the type of accident and brokerage stage. It will help avoid the potential conflict towards the secure brokerage market.
