접경지역 군사규제의 개선방안에 관한 연구

A Study on Improvement of Military Regulations in the Border Area

경기도 및 강원도 북부지역 군사분계선과 인접한 접경지역은 군사적 특수성으로 인하여 군사시설보호구역 설정 등 군사규제를 포함한 토지이용 제한의 규제를 받고 있어 지역 환경이 매우 낙후된 지역이다. 이에 따라 정부에서는 접경지역을 지원하기 위한 접경지역지원법(2000) 제정과 접경지역종합계획(2003) 수립 등의 정책을 추진하였다. 그러나 지역사회로부터 군사시설보호구역 축소·조정 및 군사규제에 상응한 정부 지원의 요구가 지속적으로 제기하고 있다. 따라서 본 연구는 시간적으로 2010년부터 현재까지로 하였고, 공간적 범위는 접경지역 군사시설보호구역으로 하여 문헌연구를 통해 연구하였다. 접경지역지원법과 군사규제와의 관계, 군사시설보호구역 운영과 갈등 실태 등을 분석하여 합리적인 군사규제 및 민-군 협력 방안을 모색하였다. 연구 결과, 접경지역 지방자치단체 및 주민들은 군사규제로 인한 지역 낙후도 심화로 정부 및 군에 대한 불만이 높은 실정이다. 따라서 군에서는 변화된 안보환경을 고려하여 군사시설보호구역을 합리적으로 조정하고 민-군이 상생할 수 있는 지역협력체계를 강화할 필요가 있다.

1. CONTENTS (1) RESEARCH OBJECTIVES Analyzing conflicts related to protection zone of military installations, one of the representative military regulations on border area in korea. Seeking rational military regulations and civil-military cooperation for the civil-military balance (2) RESEARCH METHOD Literature search method is used, searching the results of existing research, press releases, and materials of relevant institutions on military regulations on border area. (3) RESEARCH FINDINGS Derived problems of laws related to military regulations on border area including protection zone of military installations and analyzed actual management and conflicts. Formulated a way to improve rational military regulations and induce cooperation and support of the local community. 2. RESULTS Local government and the residents of the border area are highly discontent about the government and the military for the backwardness of the area is intensified due to military regulations. Therefore, the military needs to adjust the protection zone of military installations and reinforce the local cooperation system for the civil-military balance.
