GPS를 이용한 귀휴제도 실천가능성 검토

On the feasibility of GPS’ based system for release from prison

교정시설의 역할은 자유억제와 동시에 가족관계회복과 출소 후 재범을 방지하는 것이다. 이를 위해서는 외부와의 접촉기회를 많이 부여하는 사회 내 처우를 실시해야 한다. 이를 위한 방안의 하나로 귀휴제도를 실시하는 것이다. 하지만 귀휴로 인한 도주가능성과 재범가능성을 배제할 수 없어 시행을 어렵게 하고 있다. 그러므로 GPS를 이용한 귀휴제도를 실시하여 이러한 한계를 극복하는 것이다. GPS를 이용한 귀휴제도의 실시는 인권침해가 되지 않는 방법으로 시행되어야한다. 따라서 GPS 방식은 베리칩을 이용하여 몸속에 내장하거나 갤럭시 기어S2 형태로 팔목에 차는 형태로 하여 수형자라는 사실을 일반인이 알 수 없도록 해 야 한다. 교정시설에서 GPS를 차고 귀휴를 허가할 경우 수형자들의 생각을 알아보기 위해 남녀수형자 355명을 대상으로 설문조사를 실시하였다. 실시결과 남성수형자는 89.7%, 여성수형자는 71.8%가 찬성하는 것으로 나타났다. 따라서 다수의 수형 자가 악화된 가족관계를 회복하고 사회적응력을 높여 재사회화를 달성할 수 있도록 GPS를 이용한 귀휴제도를 실시할 필요가 있다.

The goal of correctional facilities is not only to suppress inmates personal freedom but also to help recover family relationship and prevent second crime after discharge. For this purpose, it may be desirable to facilitate treatment outside the facilities to allow for sufficient opportunities to have contact with outside society. It may be suggested that one of the approaches is to institutionalize release from prison. However, problems with the implementation of release from prison are possibility of escape and secondary crime. That is why the utilization of GPS systems can be a practical solution to these and problems with feasibility of release from prison. Release from prison based on GPS systems must be practiced in such a way that does not cause human rights violation such as publicity and noticeability of inmates carrying GPS systems. Therefore, electronic communication devices like veri-chips for GPS systems may be inserted in inmates body, or wearable devices like Galaxy Gear S2 may be worn on their wrists so that the identity of inmates cannot be noticed by general public. A questionnaire survey targeting 355 male and female inmates was conducted to investigate the opinion on the feasibility and effectiveness of GPS based release of prison. The findings showed that 89.7% of the male inmates surveyed, and 71.8 of the females approved of the implementation of release from prison. In this regard, it may be necessary to institutionalize release from prison based on GPS so that inmates can restore their family relationship and improve their social readjustment for resocialization.
