Domestic Legal Implementation and Prospect with the International Convention for the Protection of Cultural Heritage

As the internal and external environments surrounding cultural properties are constantly changing, countries around the world are strengthening norms for the protection of cultural properties. In Korea, laws and regulations related to various cultural properties are complementary to each other and have an organic system. Internationally, the Convention concerning the Protection of the World Cultural and Natural Heritage is being implemented. And with the Convention for the Safeguarding of the Intangible Cultural Heritage, the Convention on the Means of Prohibiting and Preventing the Illicit Import, Export and Transfer of Ownership of Cultural Property, and the Convention on Stolen or Illegally Exported Cultural Objects, the demand for the return of illegal cultural properties is also increasing. On the domestic level, based on the 「Cultural Heritage Protection Act」, it is composed of Special Act by sector such as the 「Act On The Safeguarding And Promotion Of Intangible Cultural Heritage」, the 「Act On Protection And Inspection Of Buried Cultural Heritage」, the 「Special Act On The Preservation And Promotion Of Ancient Cities」, the effect and range of application are different in a consistent system. Based on this, we examined the implementation of the International Convention on the Protection of Cultural Heritage, the prospects for the future, and improvements for the World Heritage listing procedure.
