전자환어음의 도입에 관한 법적 연구

A Legal Study on the Ways for Introduction of the Electronic Bills of Exchange - Focusing on the Electronic Promissory Note Act and Its Revision Direction

In March 2004, the Electronic Promissory Note Act was enacted to facilitate electronic payment of Electronic Trade and to avoid some problems related with paper-based promissory notes. A bill of exchange is an unconditional order in writing, addressed by one person to another primarily used in international trade. The Electronic Bills of Exchange compiles a small part of electronic commerce as a mode of business practice. The use of the Electronic Bills of Exchange is said to offer benefits both to exporters(sellers) and importers(buyers) in streamlining the documentation process. But under the Electronic Promissory Note Act, It is impossible to issue the Electronic Bills of Exchange in Korea. International transactions practice can be influenced to a considerable degree by IT(Information and Technology) industry. In international transactions practice, e-payment system is widespread. And IT industry has been growing rapidly for years. Recently Bolero has developed the SURF (Settlement Utility for Managing Risk and Finance). All these conditions may influence to the issuance of the Electronic Bills of Exchange. This article reviewed the legal issue of the Electronic Promissory Note Act and Its Revision Direction focusing on the Electronic Bills of Exchange. The author introduces more effective way to broaden the use of the Electronic Bills of Exchange. This article also suggests specific establishment of the Electronic Promissory Note Act and Its Revision Direction for solving the problem.
