TBT협정상 기술규제의 범위와 적용에 관한 연구

A Study on the Scope and Application of Technical Barrier between FTA/TBT and WTO/TBT

본 연구에서는 무역의존도가 높은 우리나라에 기술무역장벽이 위협요소라 측면을 고려하여 급속도로 증가하는 TBT 규정과 STC 현황을 확인하여 교역량이 큰 중국과 미국을 중심으로 FTA TBT 규정을 살펴보았다. 그 결과 이러한 협정에도 불구하고 여전히 국제표준과 상이한 제도, 중복된 절차, 과도한 규제로 애로사항이 발생된다는 점을 검토하였다. 이는 향후 TBT위원회를 통하여 FTA TBT 규정을 보다 명확하고 개정하여 강제성을 부여하는 협의를 적극적으로 이끌어낼 필요가 있다. 또한 이러한 노력을 함께 국내표준을 세계표준로 만들 수있는 지속적인 노력과 준비가 필요하며 이를 통해 기술장벽에 대한 대비를 선제적으로 하여야 할 것이다.

urpose : The purpose of this paper is to provide policy expert data by comparing WTO / TBT with FTA / TBT. Research design, data, methodology : This paper is composed of five chapters. Chapter Ⅰ deals with the introduction, Chapter Ⅱ explains the previous studies and definitions. Chapter Ⅲ deals with the regulations of Technical barriers and practice, Chapter Ⅳ deals with the problems and solutions by comparing WTO / TBT with FTA / TBT, Chapter V concludes this paper. Results : In the case of Korea, which is highly dependent on trade, it is recognized that the technical trade barriers are a threat, and the rapidly growing TBT regulations and STC status are examined. Conclusions : As a result, notwithstanding these agreements, it is still necessary to ensure that difficulties arise due to different systems, overlapping procedures, and excessive regulation from the international standards, and that clear and enforceable FTA TBT regulations are required and that they are in substantial agreement with the WTO / TBT Agreement, Which is expected to contribute to the revitalization of trade through global standardization.
