독일 장기요양보험법 제정과 연방의회 위원회의 역할

Enactment of the Act on Long-Term Care Insurance of Germany and the Roll of the Federal Assembly Committee

의회 위원회의 역할을 설명하는 몇 가지 주요한 이론이 있다. 위원회는 본회의에서 필요로 하는 정보를 제공하는 역할을 한다는 이론, 위원회에 소속된 의원들은 위원회 활동을 통해 자신의 정치적 이해를 실현하려 한다는 이론, 위원회 활동은 과반 의석을 점하고 있는 집권당 소속의 의원들이 당론을 관철하는 행위라는 이론이 있다. 본 연구에서는 독일 연방의회 위원회는 집권당뿐만 아니라 야당에 소속된 의원들조차 당론을 관철하는 역할을 한다고 분석했다. 이것을 증명하기 위해 독일 공적 요양보험법의 제정 과정에서 연방의회 위원회의 역할을 분석했다. 여당과 야당은 법안을 구체적으로 작성하여 당론을 반영하였다. 위원회의 법안 심사과정에서 의원들은 소속된 정당의 당론이 반영된 법조항을 지키기 위해 첨예한 논쟁을 벌였다.

There are several theories to explain the role of assembly committee. Assembly committee plays a role to give information to the plenary session of the assembly (Informational Theory), to realize each member s own interests (Distributive Benefits Theory), or to exert influence on the legislative process for the majority party (Majority-Party Cartel Theory). In this study it is analyzed that both the governing party and the opposite party try to exert influence on the legislative process in the federal assembly committee in Germany. To prove this claim, the role of the federal assembly committee was analyzed in term of the Act on Long-Term Care Insurance. The governing party and the opposite party drew up each own definite bill in which the official party platform is reflected. Considering the bills, the members of the committee have disputed to accomplish its own party platform.
