공익제보자보호제도 이행 문제점 분석

The Study on the Evaluation of Implementing Whistle-blower protections

본 연구는 부패방지법이 시행된 2002년부터 2016년까지 15년간 부패신고 기초자료에 대한 분석을 통해 공익제보자보호제도 이행 문제점을 분석하였다. 분석결과 총 14개 세부기준의 평가결과 신고 접수 실적, 이첩사건 부패혐의 적발실적, 신변보호 실적을 제외하고 모든 세부지표가 미흡한 수준으로 분석되었다. 첫째, 부패신고 처리 수준은 신고접수 실적과 이첩사건 부패혐의 적발실적을 제외하고 모두 미흡한 수준으로 평가되었다. 권익위의 부패신고 처리 인력을 보강하고 처리역량을 강화하는 것이 필요하다. 특히 신고자 상담을 통해 증거를 보강할 수 있도록 안내하여 예측되는 부패혐의에 대해 예방 또는 통제할 수 있는 역할을 갖추어 나가는 것이 필요할 것이다. 가장 저조한 이행실태를 보여준 것은 이첩사건 처리 소요기간이었는데, 평균 소요기간 5.7개월(약 170일)로 법정 기한의 3배가 넘었다. 민원처리 공공기관의 봉사자(public servant)로서의 각성이 필요 하다. 둘째, 신고자 보호조치 이행역량과 제재수준을 평가한 결과 신변보호조치를 제외하고 이행 역량이 매우 낮게 평가되었다. 셋째, 보상금과 포상금 지급 수준을 분석한 결과, 보상비율과 금액수준은 매우 낮은 수준으로 평가되며, 부패적발건수에 대한 보(포)상금지급 건수 비율도 저조하여 전반적으로 미흡하게 평가되었다. 부족한 연구를 통해 공익제보자보호제도 이행에 있어서 실질적 개선을 모색할 수 있는 실천적 단초가 될 수 있기를 기대한다.

The purpose of this paper is to evaluate implementing performance and analyze administrative problems on whistleblower protections. This study analysed with the basic statistical data from 2002 to 2016. Base on the analysis of the statistics on whistleblowering protection of Korean administration, this paper has found that the overall implementing performance is insufficient. The results of this study are as follows: First, the level of corruption report handling was low, except the increasing number of reports and the results of prosecuting suspicion cases. The lowest level of implementation was the processing period required for the handling of the case, which took about 170 days, more than three times the statutory deadline. Second, the level of whistleblower protection performance and punishment for offenders was evaluated to be insufficient, except the personal protection. Though introducing dual liability provision to enable the corporation punishment possible, there was no accusation. The ability of the Anti-Corruption & Civil Rights Commission to handle corruption hearings needs to be strengthened. Third, as a result of analyzing the compensation level, the compensation ratio and the amount level were evaluated to be very low. Therefore, there is a need to enhance the capacity to implement the whistleblower protection.
