통일대비 북한지역 토지등록 및 소유권 처리방안

A Study on Land Registration and Ownership Reorganization in North Korea for Preparation of Unification

효율적인 토지관리와 소유권 보호를 주목적으로 하고 있는 토지등록 및 소유권제도는 국가에 있어서는 모든 행정의 기본 인프라로서 그 역할을 수행하고 있다. 현재 분단되어 있는 대한민국이 통일 될 경우 북한지역에 대한 토지등록과 소유권 처리에 대한 문제의 해결방안이 제시되어야 한다. 이를 위해 분단 이전 토지등록 및 토지소유제도 현황을 파악, 분단이후 북한지역의 토지등록 및 토지소유제도 분석을 통해 통일대비 북한지역의 토지소유권 처리 및 토지등록 방안을 제시하였다. 연구결과 통일후 자본주의 국가로의 전환을 위한 기본인프라 구축 일환인 북한지역의 토지등록 및 자본주의 시장경제 체제로의 전환과 다양한 토지정책 및 행정을 위한 북한지역에 대한 토지소유권의 처리방안 가능성을 확 인하였다.

The land registration and ownership system for the purpose of the efficient land and ownership protection have been the role as a basic infrastructure of the every administration fields in a country. In case of the unification of Korean peninsula, the effective solution of the land registration and ownership disposal could be proposed. Thus, this paper is to propose the efficient land ownership disposal and the method of land registration of the north Korea as well as to analyse the land registration and land ownership during before-and-after the Korea War. Finally, it can be identified the possibility of land ownership disposal for the diverse land policy and administration but also be introduced the conversion to capitalism through the land registration as the land infrastructure in North Korea after the unification of Korean society.
