저작권법제도 개혁방향에 관한 소고

Reform of Copyright Act on New paradigm

제3차 산업혁명에 이어 제4차 산업혁명이 시작되었다는 주장들이 널리 전개되고 있는 가운데, 기술적 환경변화에 따라 저작권 제도 역시 많은 변화를 요구받고 있다. 이러한 변화의 가운데에는 개인창작환경으로의 변화, 초지능과 초연결기술의 발전, 플랫폼 중심의 저작물 이용환경, 서비스 방식의 저작물 이용환경, 클라우드 컴퓨팅과 저작물 이용의 글로벌화가 자리하고 있다. 이 중에서 초지능과 초연결은 장기적이고 범법학적 관점에서 향후 많은 연구가 필요한 분야인데 반해, 플랫폼 중심의 저작물 이용환경은 저작권 산업의 발전이라는 관점에서 그리고 서비스 방식의 저작물 이용환경은 저작권제도의 해석론적 관점에서 신속하게 변화가 요구되고 있다. 이를 토대로 개인창작환경과 저작물 이용의 글로벌 화에 따른 저작권 침해구제의 한계를 극복하고, 저작권의 창작과 이용 간의 선순환적 생태계를 마련하여야 한다.

Copyright system is seriously being affected by the 3rd industrial revolution and the 4th industrial revolution. We can find main changes on the keywords that UCC(User Created License), Artificial Superintelligence and Hyper-Connected Society, Use of Copyrightable works on the Platform, Use of Copyrightable works as a Service, Cloud Computing and the Globalization of copyright market. Among the above keywords, Artificial Superintelligence and Hyper-Connected Society make us to study for long time on the point of pan-legal view. Although, Use of Copyrightable works on the Platform and Use of Copyrightable works as a Service are asked to be resolved promptly for copyright works’ industry. For the Use of Copyrightable works on the Platform, we should study the Youtube model and make that model to make good-cycle of the creation and use of copyrightable works. Also, for the Use of Copyrightable works as a Service, we should discriminate between conditions and covenants and let the violation of covenants as the nonfulfillment of contract.
