Regulation of Global Prostitution and Korean Prostitution

Each legislation and politic is not for the punishment or regulation of prostitution itself but for the eradication of women’s exploitation, protection their human rights and life. It is impossible to eradicate or regulate prostitution perfectly in any society. Therefore, the legislation politics about prostitution is meaningful when it can control prostitution and minimize the problems. So it is necessary to make the law relatively so that prostitution should be treated as the social structural problems like rule, exploitation, and violation instead of the each behavior which is needed the moral or legal estimation. The necessity of the law is to support the organization of prostitutes, prevent human traffic and enforced detention and violation, and punish violent or abnormal pimp and buyer of sex. This is coincidence with the global legislation of the world prostitution law including the UN agreement. The approach of global prostitution needs global cooperation. When each government only enforce the regulation to prevent prostitution, there are situation of illegal entrance or movements to other countries. Therefore, the measures by cooperation among the departure country, course country, and performing country and jointing information are needed. Moreover, it is effective to the global prostitution and mediation when there are support and welfare of victims. Punishments of human traffic are regulated in Korea, and “The act of global prostitution for sexual exploitation” is punished in international law. However, organized human traffics like inflowing foreign females into prostitution are frequent. Moreover, private organizations and related ministries argue that supports of sexual victims are necessary. It is hard to decide the way of legislating politics of prostitution. It is different from the period, the character of prostitution problems, social or cultural background, and the politics of government in one country. Therefore, decision of rational countermove is necessary by the characters of each country’s social and cultural background. However, the most important principle is protecting the minors and prostitutes. Moreover, regulations of mediating prostitution have to be reinforced, and especially, the enforced prostitution, the violent prostitution, and the human traffic should be punished powerfully so that they have to be eradicated.
