기초단위 자치경찰 모델을 위한 제언

A Review on the Introduction of Autonomous Police System:

본 연구는 경찰개원회가 권고한 역단 자치경찰제 모델은 첫 째, 국가경찰의 자원(조직, 인력, 산 등)을 자치경찰에 배분한다는 내 용을 찾아보기 어렵고, 둘째, 자치경찰이 실질 의미의 경찰작용권과 일반인 범죄수사권을 보유하는지에 한 명확한 언이 없으며, 셋 째, 국가경찰의 지역경찰활동에 한 지역주민의 통제방법에 한 진 지한 논의가 빠져있다는 문제의식을 토로 새로운 기단 자치경찰 모델을 설계하고자 진행되었다. 연구결과, 향후 도입될 자치경찰제의 이념으로는 ①지역주민들의 인 지가능성과 명확성 확, ②국가경찰의 자원을 배분함으로써 경제성 확보, ③자치경찰에 한 지역주민의 통제강화, ④경찰상호간의 견제와 균형, ⑤경찰행정의 법치주의 확립으로 정리할 수 있었다. 그리고 이러한 가치들을 담을 수 있는 기단 자치모델로 첫째, 시·군·구청장 소속으로 자치경찰원회를 두고, 자치경찰원회 소속으 로 자치경찰를 운하며, 자치경찰 소속으로 지구·출소를 운 하고, 국가경찰이 지구·출소의 운인력과 산 등을 시·군·구로 이양하고, 둘째, 재 지역경찰들이 담당하는 업무는 원칙으로 자 치경찰이 담당하고 경찰서 이상 국가경찰과 상호 력할 수 있도록 사무를 배분하며, 셋째, 자치경찰에게도 원칙으로 실질 의미의 경 찰권과 일반 수사권을 부여함으로써 국가경찰과 견제와 균형을 유지 하면서 서로 경쟁할 수 있는 체제를 구축함으로써 실질인 법치주의 를 확립하고, 넷째, 지역주민들이 기자치단체장 선거, 자치경찰원 회, 지방의회 등을 통해서 자치경찰활동을 감시하고 통제할 수 있는 체제를 구축하는 것을 제안한다.

Korea adopts the National Police System. To put it concretely, the National Police Agency shall be established under the control of the Minister of the Interior and Safety to administer affairs concerning public security and in order to perform affairs of the National Police Agency by allotting them among regions, regional police agencies shall be established under the control of a Special Metropolitan City Mayor, Metropolitan City Mayors and Do Governors and police stations shall be established under the control of commissioners of regional police agencies(Article 2 of Police Act). So the police are likely to disregard the wishes of the residents. I think that Korea must introduce Autonomous Police System in order to promote inhabitants responses and realize the true regional decentralization. The purpose of this research is to introduce ways toward Autonomous Police System in Korea. To achieve this goal, I have reviewed the Government s previous proposals and presented a good model. I would like to propose the following alternatives: First, the autonomous local police systems need to be introduced on a basis of primary local governments. Second, the autonomous local police must be in charge of a general criminal investigation and risk-prevention activity. Third, The resources of the police should be distributed to local authorities. In particular, the government should hand over the district police and the police box to the local government. Fourth, Local residents must take control of local police activities. Fifth, the rule of law should be established ultimately by checks and balances between the national police and the local police.
