Examination of Harmonization Possibility of Food Safety Regulation in New Trade Environment

신통상환경에서 식품안전규정의 조화가능성 검토

Purpose : This paper analyzes the international governance situation of food safety at present and judges weaknesses and merits. To do this, I examined differences in the approach to food safety issues in the United States and the European Union. I tried to analyze the role of food safety issues and governance in the World Trade Organization (WTO) and the World Health Organization (WHO) and analyze sanitary and phytosanitary regulations proposed and adopted in the TTP and TTIP agreements. Research design, data, methodology : This paper is composed of five chapters. Chapter Ⅰ deals with the introduction, Chapter Ⅱ explains the previous studies and definitions. Chapter Ⅲ deals with the Cases of Food safety Regulations, Chapter Ⅳ deals with the problems and New regulations by comparing WTO/SPS, WHO, TTP, TTIP, Chapter V concludes this paper. Results : Considering the discriminatory characteristics of the SPS Regulations, it was judged that the justification for the application of the measure should be considered rather than the scientific evidence of the action. Conclusions : n the future TTP, TTIP and regional FTAs should discuss harmonized standards considering the essential characteristics of food safety.

식품생산의 산업화 수준이 높아짐에 따라 필연적으로 식품과 관련된 안전위험이 급속도록 증가하고 있으며, 이와 관련된 문제는 현재 국제적인 관심사가 되고 있다. 1990년대 중반 광우병 발생은 쇠고기에 대한 국제적인 수요뿐만 아니라 엄청난 경제적 손실을 가져왔다. 또한 식품의 세계화와 식품 생산방법의 국제적인 연관성이 지속적으로 증가하고 있어 식품안전문제는 전 세계적인 문제로 확장되고 있다. 각 국가들은 식품안전위험을 줄이기 위해 식품의 안전한 섭취 방법과 식품안전에 관한 엄격하고 철저한 기준을 개발하려고 노력하고 있다. 본 논문은 현재 식품안전의 국제 거버넌스 상황을 분석하고 약점과 장점을 판단하고자 한다. 이를 위해 미국과 유럽연합(EU)의 식품안전문제의 접근방식상 나타나는 차이점을 검토하였다. 이후 세계무역기구(WTO) 및 세계보건기구(WHO)에서 나타난 식품안전문제와 거버넌스에서의 역할을 분석하고 TTP협정과 TTIP 협정에서 제안되고 채택된 위생 및 식물 위생 규정을 분석하였다.
