Deliberative Process of the Constitution: Analysing the Establishment of the Constitution in South Korea

본 논문의 목적은 한국 헌법 제정과정 분석을 통해 한국헌법심의의 조건과 문제점을 찾아보고, 헌법심의의 대안적 과정을 모색하고자 하는 것이다. 한국의 헌법은 단기간의 심의, 개정을 수차례 반복하였다 민주화 개헌 이후 현재까지도 지속적으로 헌법개정의 필요성이 제기되는 가운데 헌법심의의 대표성과 그 적법성을 높일 수 있는 헌법심의 절차를 디자인해야될 필요성이 제기된다. 정치행위자들은 권력획득이라는 목표를 위해 전략적으로 행동 한다. 헌법심의의 과정 또한 정치행위자들에게는 권력획득을 위한 도구이다. 한국의 정치세력들은 권력획득을 위한 행위와 민주적 헌법을 구성하기 위한 노력을 병행한 적이 없다. 이러한 헌법심의의 문제점을 극복하기 위한 방안 으로서 헌법심의의 이원화를 주장한다. 장기적으로 헌법의 주요사항에 대하여 심의, 여론 수렴을 할 수 있는 헌법심의기구를 구성할 필요가 있다.

The main purpose of this article is analyze the establishment process of South Korea s Constitution and try to find a solution to establishment of the deliberative process of Constitution. the Constitution of the Republic of Korea had several revision for discussion in a short time. After last revison of the Constitution, many peoples still demand revision of Constitution in this times. This papers insist on new design of revision process for building up the Constitution s legitimacy. Political agent have Strategic thinking and action for the Power. Revision process of the Consitution is tool for the Power to the Political agents. This papers propose the institute of the Constitution deliberation participating in many groups in societies. In short, the case of rebuilding Consitutional order for Korean democracy shows that the most needed to stable democratic order is the new agreement and the new deliberative process of the agreement.
