남북 인적교류 활성화에 따른 법적 문제

The Legal Problems according to the Activation of Human Exchange between South and North Korea

남북교류는 물적교류와 인적교류로 나누어 볼 수 있다. 인적교류를 연혁적으로 보면 1989년 6월 12일 ‘남북교류협력에 관한 기본지침’시행이후 남북한 왕래는 주로 남한 주민의 북한방문 위주로 이루어져왔다. 특별히 주목할 것은 남한주민의 북한방문 인원이 2000년 6.15남북정상회담이후에 해마다 큰 폭으로 증가하고 있다는 점이다. 이렇게 교류가 활발해지다 보면 예기치 않는 문제들이 발생하게 되고 이에 대한 적합한 해결책이 마련되어 있지 않은 상황에서는 남북 상호간에 불협화가 빚어질 수밖에 없다. 금강산관광지구와 개성공업지구에 특별히 관심과 개발 및 투자를 하고 있는 남측입장에서는 자유로운 통행이 우선적으로 보장되어야 한다. 여기에서는 인적교류에서 발생할 수 있는 법적 문제점을 특히 신변안전문제와 형사문제를 중심으로 살펴보고 그 개선방안을 모색해보기로 한다.

Hie exchange between South and North Korea can be divided by material and human exchange. Related to human exchange by historical approach, the communication between South and North Korea has been mainly made up by South Koreans visiting North Korea. Especially the thing that needs to be concentrated is the number of South Koreans visiting North Korea is increasing dramatically since the Summit Talks between South and North Korea on June 15，2000. As the exchanges activated like this, unexpected problems may happen and the discord between South and North Korea cannot help being broken in the circumstances which have no appropriate solutions. The South part which has concern, is developing and investing on *Mt. Kumgang Tourist Zone‘ and Kaesong Industrial Zone’ wants to be ensured of the right of passing preferentially. Here after, legal problems in the course of human exchange, particularly about personal safety and criminal case will be examined and the possible resolutions will be also founded.
