중재 활성화를 위한 법원의 역할

중재는 분쟁을 법원의 재판에 의하지 아니하고 중재인의 판정에 의하여 해결하는 대표적인 대체적 분쟁해결수단이다. 특히 국제거래에서는 상대방 국가의 법체계에 대해서 잘 모를 뿐만 아니라, 상대방 당사자가 속한 국가의 법원은 편파적인 판단을 내릴 것이라는 우려 등으로 인해 소송 보다 중재를 선호한다. 게다가 중재는 해당 국가에 미치는 경제적 파급효과도 크다. 큰 규모의 국제중재사건을 유치할 경우, 해당 국가에 법률 서비스, 호텔, 중재센터 등 많은 일자리를 창출하므로 세계 각국이 자국에 중재사건을 유치하기 위해 경쟁하고 있다. 중재는 사적 자치에 의한 분쟁해결방식이지만, 그 성격상 법원의 역할과 긴밀하게 연결되어 있다. 따라서 일반적으로 중재와 법원의 관계를 논할 때 가능하면 법원이 중재에 최소한으로 관여해야 한다고 하지만, 실제로 중재 활성화를 위해서는 일정 범위 내에서 법원이 중재절차 진행에 적극적으로 지원할 필요가 있다. 본 연구보고서는 특히 국제중재를 중심으로 하여 중재제도 일반에 대해 살펴본 다음, 우리나라와 외국의 중재제도와 그 절차 안에서의 법원의 역할을 비교·분석하고, 이를 바탕으로 우리나라에서의 국제중재 활성화를 위해 법원이 어떤 역할을 담당할 수 있는지를 제시하고자 한다.

Arbitration is a method of dispute resolution in which the parties submit a dispute to an impartial person who has been selected by the parties for a final and binding decision. Arbitration can provide a prompt and efficient method for resolving disputes without the expense, delays, or complications that are inherent in litigation. Commercial arbitration continues its global growth – with very significant increases in the number of disputes initiated, as well as in the monetary sums in dispute. This strong trend can be partially attributed to developing and rapidly industrializing economies, and the consequent increase in business opportunities and ensuing disputes. Although arbitration is a private method of dispute resolution, the importance of judicial support for the development and growth of arbitration on both the domestic and international level cannot be underestimated. The judiciary must be actively involved and demonstrate a willingness to support arbitration, facilitating its processes and enforcing its results. In this research paper, the author discusses the key features of arbitration, theories behind judicial intervention in arbitration and the role of courts on the major concepts of arbitration.
