E-Commerce Trends in Japan: Focusing on Laws and Systems

일본의 전자상거래 동향 : 법과 제도를 중심으로

연구목적: 인터넷을 이용한 전자상거래가 시간과 장소의 제한 없이 누구나 참가할 수 있다는 장점 때문에 확대되고 있다. 여기에 정보처리기술의 발달로 비교적 짧은 기간에 영역이 확대되고 있다. 그러나 국경을 초월한 거래가 많아지면서 새로운 법개정과 제도적 정비의 필요성이 요구되고 있다. 이러한 상황을 인식하고 본 연구는 전자상거래 동향과 관련 법·제도정비 등에 대해 살펴보고자 한다. 이는 새로운 형태의 거래가 증가하면서 법률적 문제가 야기되어 전자상거래 등을 규율할 수 있는 법제도 정비가 어떻게 진행되고 있는지 파악하고 분석하여 시사점을 도출하기 위함이다. 논문구성/논리: 연구에서는 전자상거래 동향을 B2C 기준으로 살펴보고 그 특징을 도출하고자 한다. 이어서 전자상거래 촉진을 위해 어떻게 제도정비가 진행되었는지를 살펴보고자 한다. 이는 민법 등 현행법 대부분이 새로운 기술을 전제로 하지 않고 제정 되어 다양한 형태의 전자상거래가 증가하면서 문제의 발생을 법률적으로 어떻게 적용, 대응하고 있는지를 살펴보기 위함이다. 전자상거래 관련 법률이 다양한 분야에 걸쳐있 어 준칙 개정의 내용에 대해서도 검토하고자 한다. 결과: 전자상거래가 확대되고 있지만, 특정 분야에 한정되어 있는 것으로 나타났다. 이는 정보화 사회에서 중요한 사회간접자본이 인터넷이라고 할 수 있고, 인터넷 이용자 수의 증가에도 불구하고 제도 및 시스템의 미흡으로 규모 확대의 한계에 직면하고 있다는 것을 의미한다. 문제는 재화중심의 거래에서 정보재의 거래로 전환되고 있어 제도적 보완이 지속적으로 이루어져야 한다는 것이다. 이는 편리성과 정보보호가 맞물려 있기 때문에 신중한 접근이 필요하다. 독창성/가치: 이 연구는 전자상거래 규모에 초점이 맞춰져있던 기존 연구의 한계를 극복하고 시장규모 확대에 따르는 법제도의 정비 상황을 분석하였다. 연구를 통해 전자상거래의 규모 확대를 위해서는 정보처리 기술발달에 대응할 수 있는 다양한 분야의 제도정비의 필요성이 확인되었다.

Purpose: The market size of e-commerce using the internet is expanding, thanks to its inherent merit in that anyone can participate in it, regardless of time and space. In addition to this, with the development of information processing technology, the area expands in a relatively short period. However, as transactions across borders increase, the revision of laws and the maintenance of systems are needed. Recognizing this situation, this study aims to investigate the trend of e-commerce and the maintenance of laws and systems. The purpose of this study is to draw implications by assessing and analyzing how legal systems that can regulate e-commerce are maintained in a situation where legal problems are caused as new forms of transactions increase. Composition/Logic: This study examined the e-commerce trend in the fields of products, services, and digital devices and draw upon the characteristics. Further, this study examined the maintenance of the systems for the facilitation of new technologies since the 1990s. This is because most of the current laws, like civil law, have been enacted, but are not in the premise of new technologies. This study enables the interpretation of how one can legally apply the occurrence of problems as the number of e-commerce transactions across borders increase and can draw up a direction for future policies. Findings: This study found out that e-commerce has expanded, but its expansion has remained limited to certain areas. It can be interpreted that the internet is an important social overhead capital in the information society. As the number of users on the internet faces limits, it is concentrated in certain areas. Further, as the size of e-commerce has expanded, detailed items of systems have been maintained, and this in turn, has suppressed the occurrence of problems. Originality/Value: This study overcame the limitations in past studies that focused on the size of e-commerce and analyzed the situation of the maintenance of laws and systems according to the expansion of the market. Through the study, it was found that it is necessary to maintain systems in various areas in order to cope with the development of the information processing technology to expand the size of e-commerce.
