A Study on Prosecutor and Administration Architectural Particulars of Urban Detention Centers in Downtown Justice Facilities Complex : Focused on Architectural Particulars of Downtown Detention Centers in American Justice Facilities Complex

검찰청, 법원과 구치소(교도소)는 범죄의 경중을 조사하고 형량을 결정하여 법의 집행의 기능을 수행함에 있어서 불가분의 관계임은 주지의 사실이다. 검찰의 공소와 유지의 행정처리를 효율적으로 수행하고 법원의 판결을 이끌어내는데 있어서 법원 검찰청과 구치소를 한 지구 내에 인접하여 배치하거나 복합화 시키는 것은 매우 중요하다. 특히 미국의 경우 도심 내 법원, 검찰청과 구치소가 인접하거나 혹은 검찰과 구치소가 하나의 건물에 프로그램화되거나 때로는 간이법정까지 복합화 되어 있는 사례가 많다. 미국의 이러한 구치소 유형에서는 1년 이하의 상대적으로 경미한 범죄의 판결까지도 신속하게 이루어지고 있으며, 법조타운 내 도심 복합형 건축군을 이루며 오래전부터 각론적으로 완성되어 실행되고 있다. 도심복합형 법조타운은 검찰 및 구치소, 검찰, 법원, 구치소 복합형이 있었으며 때에 따라서는 세 가지 기능이 동시에 단면적으로 이루어지는 경우도 있었다. 이는 경찰에서 범죄자를 체포하여 송치한 이후 원스톱으로 조사, 구치소 수감, 검찰 공소권 유지, 판결이 원스톱으로 수행된 후, 교도소에 바로 이감함으로써 기능의 원활한 이행과 함께 시설별로 뚜렷한 각론적 사항이 충족되고 기능이 원활하게 수행되는 장점이 있다.

It is a matter of common knowledge that police station, prosecutors office, district court and detention centers(jail) are close and undetachable relationship each other carrying out investigation, judging, transferring to correctional facilities. For investigating inmates and making judgement from the court, the close arrangement and complex of each institution in same district or in one building is essential for one-stop law enforcement. In American example, we can find many complexed facility and connected institutions for effective civil or criminal law enforcement activity. Especially, American detention centers are mainly located in downtown and are complexed with district prosecutors office and small court inside of the building together. For a long time, American urban complex detention center has been completed and developed its type as a architectural particulars.
