A Review on the draft of UNCITRAL Guide to Cloud Computing Contracts

Cloud computing services are essential for data-driven information societies. Cloud computing services binding the contracting parties and determine legal relationships, including rights and obligations. However, these contractual relationships are not always concluded as a reasonable outcome between equal parties. If a cloud computing service provider is a large global company, small and medium businesses are not easy to make changes to contracts, even when they are paying for and using services. UNCITRAL is currently discussing a draft guide to several issues in a cloud computing contract. This report looked at the background of proposals in the draft of UNCITRAL Guide, and the main contents and issues in the draft of UNCITRAL Guide, focusing on the 55th and 56th discussions of UNCITRAL WG IV. In addition, it drew implications by comparing Korea s Cloud Computing Service Standard Agreement, which was established in 2016.
