A Study on the legal Possibility and the Institutionalization of Consociational democracy in Unification by Agreement of the two Koreas

Unification by agreement should be based on the outcome of political choices based on the free will of all members of the two Koreas, so it should follow the democratic process in which constitutional principles are exercised. Thus, the systematic nature of a unified nation which can be realized by the unification constitution, liable to establish at the end stage of the Korean Commonwealth or low stage of federal, is based on the political changes of the two Koreas by the agreements of two Korea s political force. In this regard, it is likely that the consociational democracy will be discussed in the political process of the two Koreas during the unification by agreement. At the same time, unification by agreement requires the establishment of an institutional peace regime centered around the Korean Peninsula for external environment. There is no specific contents in our unification plan, Unification Plan of National Community , preparing for inter-Korean political process that will take place in the process of peaceful reunification, and no institutional mechanism for the future form of a unified nation at the stage of the Korean Commonwealth. If the Constitution is revised, minimum agreement should be made on the political system and ideology related to the nature of a unified nation.
