헌법전문과 6월항쟁의 헌법적 의미 — 민주공화국 원리를 중심으로 —

Constitutional Implications of the People’s Uprising of June 10th and the Preamble of the Constitution ― With focus on the Principle of a Democratic Republic ―

문재인 대통령의 헌법개정안이 국회에서 투표불성립으로 부결됨으로써 개헌논 의가 소강상태를 맞고 있다. 그러나 정식으로 헌법개정안이 발의되고 공고되었다는 점에서 이 개정안에 대한 여러 논의를 충분히 공론하여 향후 개헌논의의 발판으로 삼아야 한다. 문재인 헌법개정안이 논란을 야기한 여러 쟁점 가운데 역사적 사실을 헌법전 문에 명기하는 논점이 포함되어 있다. 이 글은 6ㆍ10항쟁 혹은 6월항쟁과 같은 역사적 사건을 헌법에 명기하는 것이 어떻게 정당화될 수 있을 것인지에 대한 나름의 헌법이론적, 헌법사적 논거를 제시하는 것이다. 이 글에서 필자는 비교법적으로 헌법전문의 내용에 관한 보편적 기준이 없다는 점, 1948년 이래 우리나라의 헌법사가 역사적 사실을 전거로 헌법의 정체성을 제시하는 특별한 전통이 있다는 점, 헌법의 정체성을 가름할 핵심가치인 민주 공화국원리가 반독재, 법치, 경제민주화와 사회정의의 구현이라는 헌법적 함의를 가지는 바 6월항쟁은 이 세 가지 함의에 모두 부합하는 특성적 가치를 가진다는 점이 헌법전문에 명기할 수 있는 정당화사유에 해당된다고 주장한다. 나아가 필자는 6월항쟁이 민주공화체제를 보호하고 발전시키고 하는 주권자의 결연한 의지와 미래에 대한 비전을 보여주는 대표적 사례이며 헌법이 살아있는 규범으로서 기능하도록 하는데 긴요한 역사적 생동감을 제공해 주는 시민교육 내지 헌법 교육의 주요한 소재가 될 수 있을 것이라는 점도 부수적인 논거로 제시하였다.

This article aims to verify that the People’s Uprising of June 10 th deserves to be explicitly stated in the preamble of the constitution as President Moon proposed in his constitutional revision bill. The author argues basically on three accounts. First, a comparative constitutional study on preambles of the countries in the world shows no universal trend. Second, Korean constitutional history features the use of specific historic cases such as independence movement on March the 1st and the Revolution of April 19 th in the preamble. Third, the People’s uprising of June 10 th has three basic implications stemmed from the principle of a democratic republic as the most important value envisaged as the core constitutional identity – anti-despotism, the rule of law and the democratization of the economy or social justice. In addition, the author also argues that the constitutionalization of the People’s Uprising of June 10 th will be a token of the Korean nation’s firm will to protect a democratic republic and to cast a clear warning against any abrupt attempt to deteriorate it, and can be used as a good resource of civic education to enhance constitutional democracy in South Korea.
