지방선거에 있어서 지방분권 실현 방안에 관한 연구

A Study on Realization of Local Decentralization in Local Election - Focusing on participation of political parties -

지방선거가 치러질 때마다 정권 중반에 있는 지방선거는 정권심판론이 대두되었다. 이번 선거도 마찬가지이다. 지방선거가 지방정부를 구성하는 축제이지만, 중앙 정치의 대리전과 같은 상황이 반복되어 오고 있다. 지방선거에의 정당참여로 인하여 지역주의구도가 심화되었고, 공천과정에서 공천헌금 등의 각종 비리가 발생하였고, 지역주민보다 당에 충성된 후보자들이 공천 되었으며, 지방선거가 중앙정치에 지배되고, 사실상 지방자치가 무의미해지는 현실 앞에서 많은 학자들은 정당공천을 폐지하거나 또는 최소한 기초자치단체 차원에서는 배제하자고 주장하고 있다. 그러나 정당참여가 가져오는 순기능이 있기에 정당참여를 유지하자는 견해가 계속 대립되어 오고 있으며, 여전히 이에 대한 논의가 정리되지 않은 상황이다. 그러나 이러한 문제점들은 지방선거에 정당이 참여하기 때문에 발생하는 문제가 아니라, 불투명하고 비민주적인 정당공천 방식, 중앙정당만이 독점하는 공천방식으로 인하여 발생하는 문제인 것이다. 따라서 지역과 주민에 기초한 상향식 정당체제로 발전되어야 하며, 정당의 분권화가 이루어질 때 비로소 해결되는 문제이다. 사실 정당공천의 폐지에 대하여 주장하고 있는 견해도 정당참여의 순기능을 인정하지만, 우리의 정당문화와 정치의식이 성숙되기까지는 정당참여를 유예하여야 한다는 주장이 많다. 그러나 우리의 정치의식과 정당문화가 성숙되기를 기다리며 차선을 택하기 보다는 성숙한 의식과 문화가 정착되도록 제도를 마련하고 구축하는 것이 더욱 근본적인 방안이라고 생각된다. 구체적으로는 지방선거 공천과정이 투명하고 민주적으로 이루어지도록 후보자의 추천이 정당 공천절차를 준수하였는지를 검토하고 공천절차의 최소한 기본요건을 갖추지 않은 경우에는 후보자등록신청의 수리를 거부할 수 있는 심사권을 선거관리위원회에 주는 것이 필요하다. 그리고 각 정당은 공천절차 즉, 경선방식, 심사방식, 공천완료시기 등을 명문의 규정으로 구체화하도록 정당법을 개정하는 것이 필요하다. 또한 당규에 위반한 공천의 효력을 다툴 수 있는 사법적 구제절차를 마련하여야 하고 또한 공천절차를 정한 당헌 당규에 대한 위헌심사가 가능하도록 공직선거법 등의 관련 법률을 개정할 것을 제안하고자 한다. 또한 정당이 공천후보자에 대한 엄격한 검증을 하도록 공천에 대한 정당의 책임관리제를 도입하는 것이 필요하다고 생각된다. 지방자치가 발전되고 지방분권이 실질적으로 이루어지기 위해서는 지방선거가 지방의 문제에 집중함으로 지방정치의 본질적 역할을 충실히 수행하는 것이 요구 된다. 그리고 이러한 지방의 상황과 주민의 요구에 대응하는 적절한 정책을 계획 하고 시행하기 위해서는 지방정당 등 다양한 정치세력이 지방선거에 참여할 수 있도록 정당법 등을 속히 개정하는 것이 필요하다.

In fact, the views that claim abolition of party nomination also recognize the good function of party participation. However, there are many arguments that we should postpone political participation until our party culture and political consciousness mature. However, it is more fundamental to establish and build a system in which mature consciousness and culture are settled rather than choosing the next alternative while waiting for our political consciousness and political culture to mature. Specifically, the Election Commission should review whether the nomination is in line with the party nomination process. And the minimum requirements of the nomination procedure are not met, the Election Commission shall be authorized to refuse to apply for a candidate registration And each party should revise this law to specify naming procedures such as the method of competition, method of examination, and timing of nomination. We also need to revise relevant laws, such as the Public Election Law, to provide judicial remedies so that we can contest the nomination violations. And introduce a system of accountability to political parties to ensure that each party carries out rigorous verification of candidates. In order for local autonomy to be developed and decentralization to be practical, local elections should focus on local problems. In order to plan and implement appropriate policies for local conditions and the needs of residents, various political forces such as local political parties should be able to participate in local elections.
