통일 이후 북한지역의 지방자치를 위한 법ㆍ정책적 과제

Legal policy challenge for the implementation of local autonomy in North Korea area after Korea unification

한반도 통일과 함께 발생할 문제들을 미리 완벽하게 예측하고, 그에 따른 대응 방안과 법제도를 사전에 정비하는 것은 불가능에 가깝다. 그러나 우리는 통일과정 전반에 걸쳐 예측되는 상황을 선제적으로 논의하고 가장 바람직한 해결방안을 도출하는 것을 게을리해서는 안 된다. 왜냐하면, 분단국가로서 대한민국은 북한과의 관계에서 발생하는 문제를 해결해야 하고 헌법적 요청을 차치하더라도 후손에게 분단국가의 아픔을 물려줄 수 없기 때문이다. 통일 이후 북한지역 지방자치 시행은 통일한국의 주인으로서 자부심과 통일한국의 소속감을 높이는 핵심요소 중 하나이기 때문에 그 중요성에 관하여 다언을 요하지 않는다. 북한지역 주민은 과거 상명하복의 중앙집권적 행정체계에서 벗어나, 자신이 거주하는 지역의 행정대표를 선거를 통해 선출하거나 지역행정의 일정부분 스스로 결정하는 체계로 전환됨에 따라 통일한국의 주권자로서 지위를 피부로 느끼고 한반도의 전사회적 통합과 실질적 통합에 동참하게 될 것이다. 그러나 3대에 걸쳐 강력한 중앙집권적 체제 하에서 살아온 북한지역 주민에게 현실적으로 효과적인 지방자치를 기대하는 것은 어려움이 있다. 따라서 통일 이후 북한지역에 지방자치를 시행함에 따라 발생하는 문제들을 선제적으로 검토하여 이에 대비할 필요가 있다. 통일 이후 북한지역의 지방자치제를 시행하는 것은 당연한 국가적 과제이다. 규범적 검토를 통해 확인했듯이 통일 이후 북한지역 지방자치의 시행은 자유민주적 기본질서와 민주적 기본질서에 의해 규범적 당위성이 도출되기 때문에 이를 배제 하거나 형해화하는 것은 불가능하다. 시행시기와 관련하여서는 규범적 논의와 정책적 논의를 통해 즉각적인 시행이 바람직하며, 그 전제로 북한지역의 특수한 상황을 고려한 수정된 지방자치제도가 필요하다. 또한, 북한지역 지방자치단체의 조직형태는 입법정책론에 따라 결정될 수 있으며, 북한지역 공직자 중에서 행정의 전문성을 가진 북한 지방행정 공직자를 즉시 임용할 필요가 있다. 지방재정상 재 원 확보의 측면에서 북한지역 국유재산의 지방자치단체에로의 귀속가능성에 대해서는 독일의 사례를 중심으로 검토하였는데, 지방자치단체에서 직접적으로 사용하는 재산은 지방자치단체에 귀속하는 것이 바람직하며, 직접적으로 사용하지 않는 국유재산은 북한지역 재건을 위하여 사용하는 것을 전제로 중앙정부에 귀속할지 지방자치단체에 분배할지를 통일정책에 비추어 결정해야 한다. 마지막으로 북한지역 지방자치단체의 성공적 정착을 위한 해결기제로서 지방자치단체 간 교류협력이 필요하다. 즉, 서로 상이한 이데올로기와 정치체제 속에서도 남북한의 이질성을 극복하기 위한 수단으로 지방자치단체 간 교류협력의 역할이 매우 중요하다는 것이다.

It is almost impossible to predict and resolve the issue of Korea unification in advance. However, we should not neglect to discuss the expected situation throughout the unification process and come up with the most desirable solution. Because the Republic of Korea should solve the problems related to North Korea and apart from constitutional requests, we can not pass on the same pain to our descendants. It is very important to implementation of local autonomy in North Korea area after unification because it is one of the key factors to feel a strong sense of belonging Unified Korea. However, it is difficult to expect effective local autonomy for North Korean area resident who have lived under a strong centralized regime for three generations. Therefore, it is necessary to review and prepare for problems arising from the implementation of local autonomy in North Korea. It is an indispensable nation s challenge to implement local autonomy in North Korea area after unification. As confirmed by normative review, it is impossible to rule out or deregulate the implement local autonomy in North Korea area after unification. and it is desired that immediate implementation of revised local autonomy with consideration for the specific circumstances of the North Korean area. The organizational form of local governments in North Korea area can be determined according to the legislative policy theory. Public officials in North Korea with administrative expertise should be re-appointed immediately. However, they should be reeducated and not considered an exceptional reason for dismissal. It was reviewed based on the case of Germany whether national property is vested in local governments. Administrative property should be vested in local governments, and miscellaneous property should be decided by the unified government within the framework of reconstruction of the North Korean area. Finally, it is necessary to exchange and cooperate between the South Korea local governments and the North Korea local governments. If such exchange and cooperation is activated, local autonomy in North Korea area will be established as a success.
