도와 시·군간 조례제정권의 배분기준에 관한 고찰

지방자치법이나 지방자치분권 및 지방행정체제개편에 관한 특별법과 같은 일반법에서는 광역과 기초의 입법권배분에 관해 일반원칙을 규정하고 있다. 하지만, 개별 특별법들에서 특정 업무의 입법권에 관하여 다르게 규정한 경우에는 그 기준에 따라야 한다. 하지만, 개별 특별법의 규율내용이 광역과 기초간 권한배분과 관련하여 흠결상태이거나 불명확한 경우도 존재한다. 이때에는 일반법에 규정된 권한배분의 원칙들이 적용되어야 한다. 이 글에서는 원주시내버스운송사업의 적자보전을 위한 재정지원업무에 관하여 입법권의 관할을 놓고 강원도와 원주시가 갈등을 보이고 있는 사례를 대상으로 도와 시·군간 조례제정권의 배분기준에 관하여 분석고찰 하였다. 여객자동차운수사업법은 시내버스에 대한 시의 재정지원업무에 관한 입법권의 소재에 관해 명시적인 규정을 두고 있지 않다. 하지만, 법제처는 기존에 여러 차례 유권해석을 통해 시내버스나 군내버스의 적자보전을 위한 시·군의 재정지원업무에 관해 광역자치단체에게 조례제정권이 존재함을 이유로 시·군의 조례제정권은 허용되지 않는다는 의견을 제시했었다. 법제처의 기존 유권해석의 핵심적인 논거는 여객자동차운수사업법이 사업면허권을 광역자치단체에 부여하고 있기 때문에 시·군이 재정지원하는 경우도 도의 조례로 규정해야 한다는 것이었다.(면허권설). 하지만, 특별법에서 권한배분에 관해 특별한 규정을 두지 않고 있을 때에는 일반법에 규정된 입법권의 배분원칙에 따라 권한이 배분되어야 한다는 점에서 법제처의 기존 유권해석은 의문이었다. 이 글에서는 개별 법률에서 명시적으로 조례제정권의 배분에 관해 지시하지 않을 때, 다음의 조건이 충족되면 주민복리사무에 관해 기초자치단체에게 조례제정 권이 존재한다고 보아야 한다고 주장하였다. 주로 해당 지역주민의 복리에 직접적으로 영향을 미치는 사무일 것 해당 지역의 관할구역내에서 대상 활동이 이루어질 것 해당 기초자치단체가 단독으로 재정지출을 하거나 단독으로 그 업무를 처리할 수 있는 성질의 사무일 것이 입장을 단독관할 + 재정부담 결합설 또는 줄여서 결합설이라고 불렀다. 법제처가 대상사례에서 기존의 입장을 대전환하여 원주시에게 조례제정권을 인정하는 방향으로 새로운 해석을 제시한 것을 환영한다.

General acts about local autonomy, which are ‘local autonomy act’, and ‘decentralization and government system reform act’, regulate general criteria and principles in allocating provincial and municipal legislative competences. If special acts allocate provincial and municipal legislative competences differently, the criteria must be respected. If a special act gives no or obscure directions in allocating legislative competences between provincial and municipal governments, general criteria and principles must be respected. The main thema of this article is about the allocation criteria of provincial and municipal legislative competences. When Wonju City subsidizes financial deficits of city buses, who has legislative competence about the subsidy between Gangwon Province and Wonju City? Korean ‘passenger bus traffic business act’ has not clear regulations about legislative competences of municipal subsidies. Nevertheless, Korea Ministry of Government Legislation has made center-oriented authoritative interpretation several times, which supported provincial legislative competences about municipal subsidies, because provinces have the license competence about passenger bus traffic businesses. However, in general acts about local autonomy, general criteria and principles allocate legislative competences by the territorial jurisdiction, when a special act gives no or obscure directions in allocating legislative competences between provincial and municipal governments, In this article, the writer suggested a new criterium, territorial jurisdiction + financial responsibility combination, about legislative competences of municipal subsidies. That is as follows. When municipal affairs are related to citizens’ welfare in the municipal territory, and a city alone supports the subsidy like municipal subsidies for city bus companies, the city has the legislative competence.
