온라인 분쟁해결(ODR)에 관한 연구

온라인 분쟁해결이란 대체적 분쟁해결절차에 있어서 각 당사자의 주된 소통과정이 온라인 소통방식을 통해 이뤄지는 것을 말한다. 공식적인 사법절차를 보완하기 위해 대체적 분 쟁해결이 등장하였다면, 온라인 분쟁해결은 소통방식을 개선함으로써 이들을 더욱 보완하고 개선하는 분쟁해결방식이 된다. 온라인 분쟁해결은 종전의 대면방식의 분쟁해결절차를 온라인상의 비대면 방식으로 전환시킴으로써 비용을 절감하고 효율성과 편의성 등을 증진시키는 장점이 있으나 반면 공정성과 신뢰성 및 합법성 등을 확보할 필요가 있다. 본 연구보고서는 온라인 분쟁해결의 프레임워크가 되는 필요조건을 정리하고 제도의 기본 설계 방식을 소개하였다. 한편, 온라인 분쟁해결은 전자상거래, 특히 국제 전자상거래에서 그 수요가 증가하고 있다. 이러한 이유로 종래 OECD나 UNCITRAL에서 논의되어온 국제적 차원의 규율 내지 가이드라인의 형성과정을 간략히 소개하였고 이어서 특기할만한 해외의 사례로 미국, 유럽 연합, 네덜란드, 일본 그리고 중국의 온라인 분쟁해결 이용현황을 살펴보았다. 사법이 온라인 분쟁해결의 관념을 어떻게 수용할 수 있을 것인지에 대해서는 리걸테크와 사법접근권이라는 두 가지 큰 방향을 먼저 설정한 뒤, 멀티도어 코트하우스 모델과 전자사법제도에서 온라인 분쟁해결 관념의 수용, 특히 나홀로소송과 온라인 분쟁해결의 연결 점을 통해 실천방안을 모색해보았다.

Online Dispute Resolution(“ODR”) stands for the application of Alternative Dispute Resolution(“ADR”) practices and theories with the deployment of online communication channels between the parties. While ADR emerges in order to complement the formal judicial process, ODR further enhances the dispute resolution scheme by improving the methods of communication. Even considering that ODR reduces costs and brings an efficiency and convenience to the resolution through replacing previous physical face-to-face meeting with non-face-to-face online communication, it is still required to secure impartiality, credibility, and legitimacy. This paper summarizes the requisites of ODR framework and introduces a basic planning method of the system. Demand for ODR has been increasing in the field of electronic commerce, especially international one. In this regard, the formation process of rules or guidelines at the international level that has been discussed by OECD or UNCITRAL is briefly introduced, and the status quo of ODR in the United States, the European Union, the Netherlands, Japan and China is examined. This paper sets two directions―legal technology and access to justice―on how the judiciary could accept the idea of ODR, and then figures out the concept of the multi-door courthouse model and a practice plan for acceptance of the idea of ODR in the electronic justice system, especially in connection with pro se litigation and ODR.
